Approved April/May/June Filers waiting for NVC

guys! i have another question ... if anyone can help me...

About the I-134... my wife has all the papers from income tax, bank... but she order TAX TRANSCRIPT too for the last 3 years from IRS. my question is... what is best to send to me for interview?! Should tax transcript from IRS be legalised or not ?!

I would suggest using the transcripts. If the tax forms are used the Embassy/Consulate could ask to see the original w-2 forms. Also, the transcripts do not need to be notarized as they are from the IRS. Meaning the transcripts are legal documents.

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

Please note that I am asking after I read the instruction + the example filled forms here in VJ

I am confused or maybe paying to much attention and focus that I start to lose it, the following questions on I-134 are challenging me

On page# 1

“I have other personal property, the reasonable value of which is:”

Is that any personal property like the value of thinks you own in your home

On page# 2

“With a cash surrender value of:”

This came right after asking about the life insurance amount, but I still can’t understand what the “cash surrender” is

On page# 2

Also question number 10 : I intend do not intend to make…etc

My wife will be living with me and I will cover all her expenses, so what should I answer

I received packet 3 in the mail today :dance:

The letter was dated the 27th, which was the same day I phoned them and was told they hadn't received my petition yet :wacko: Oh, well, stranger things have happened in this process I suppose ;)

Now I have a dilema... I have all of the paperwork I have to submit at the interview, except the I134 and it's supporting evidence (transcripts etc). Josh and my mum in law are still waiting for the transcripts to arrive. Do I chance it and send the form back to say I have everything or do I delay my eventual interview by however long it takes to receive that evidence? The average time for a London interview is 2 months.

From what I read in the instruciton for I-134 the IRS transcript are not must, you can still give copys of the Tax forms along with the W-2 proff of income, and things can even be faster if he uses online Tax sites, if he does then he can send those copes in PDF format to your email, also you can get the transcript faster, let him ask them to be sent by fax, so he can also attach that with the copes of the tax form and W-2, I have done that when I was going through citizenship with USCIS, it helped me a lot.

A question to you about packet# 3, what was in it? like what is the check list of the requirement?

The transcripts normally only take 10 working days to arrive, so they should be arriving soon. Just remember if you use the tax forms the Embassy/Consulate can request to see the originals. And if the IRS does an audit they will want the originals. Chances are this will not happen.

I called the NVC today and they have not received our stuff yet. I'm confused about what is going to happen next. I thought the NVC was going to send a bill to me and to my spouse, one for AOS and one for visa processing. The lady at NVC told me that all they do is enter our information into the computer and forward everything on to the embassy. She said we would receive a bill from the embassy. Is that correct? She gave me the number for the consulate in Lagos so I can call with general questions, but I thought I would ask here first. I'm just trying to get this all straight! Thanks for any information you can provide. :unsure:

From your signature it seems that you have your I-129F approved, so why don't you go with K3 visa, it's way faster then going through CR1, so no bill to be waiting for or anything.

Yesterday I called Bogota embassy and They has been recieved my case 26 Nov and I sent my package 3 for fax today

My case has made it to the embassy too. Will post an updated chart soon. Real busy at work........

Thanks Urge. We are going with the K-3. Oh gosh! I'm feeling extremely challenged in the brain department right now. Sorry. I called about the I-129F and that's what she told me. Somebody please school me here. Evidently, I'm even more ignorant about all of this than I thought. When I read the directions for what was going to happen next, it said we would get a bill (two actually). I suppose I have read the wrong thing! I refuse to let this process make me crazy!!! :wacko: HELP! Please.

For the K3, you will not get any bill from NVC. NVC has it for about 2 days, they quickly send it off to the embassy.

The whole CR1 vs. K3 for you is moot. You do not really have a choice at this point. See here: http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf

As explained in the linked release, once you file the I129F, and they link your petitions as they have done and approve both together, only the I129F goes to NVC and the I130 is held in storage for eventual AOS. You would have to file an I824 to get it out of storage if you wanted the CR1, but that would take months for USCIS to process. So you will really have to go K3.

But anyway, if you wanted to know how NVC works if you were going CR1, you and your spouse would get a DS3032, choice of agent. You would also get an affidavit of support bill for $70. Once the DS3032 is returned by your spouse designating you as the agent of choice, you would get the immigrant visa fee bill. When you pay the affidavit of support fee bill, you would get the I864 sent to you. When you pay the IV fee bill, you will get the info packet for the IV with the appropriate forms ( DS 230, etc.) to fill and return to NVC. The whole NVC process takes 2-6 months for CR1 before going to the embassy.

Somebody familiar with Lagos can tell you how they handle the nonimmigrant visa fee for K3. It will be $100, and paid in Nigeria. Generally, there are two ways that they go about it. It will either be paid at a bank and the receipt taken to the embassy or paid at the embassy directly (when returning packet 3 or at the interview if they use a single info packet). But like I said, you would need to get the details related to Lagos by either calling them or someone who knows Lagos could answer here.
