Do I need my 2004 taxes?

Timeline

My husband and I had our petition interview about two weeks ago at the embassy in Cairo and after about one week they sent us the packet with the second step. My husband now has his police report and medical exam. My parents are the sponsors for my husband since I am not working and I have a copy of all their taxes from 2004 through 2006. My question is, do I need a copy of my 2004 taxes? The embassy told me that I still need to fill out I-864 even though my parents are the sponsors and I have my 2005 and 2006 taxes.

08/xx/2004: Met online

08/19/2007: Married in Egypt

03/21/2007: ~E~ Moved to Egypt

CR1-IR1 Timeline (DCF at Cairo)

10/11/2007: I-130 Petition Interview at Cairo Embassy - Petition Accepted

10/18/2007: I-130 Petition Approved! - Confirmation email from embassy

10/18/2007: "Step Two" packet (Packet 3) received via DHL

11/26/2007: Visa Interview

12/04/2007: "Proof of Domicile" received at Embassy

12/30/2007: "Proof of Domicile" approved; visa to be issued this week! - Not issued

01/13/2008: "Case pending Administrative Processing"

01/15/2008: AP completed; case under final review

Better safe then sorry. I read three years of taxes are needed but I could be wrong.

Yes, you still need to fill out an Affidavit of Support in spite of the fact you have not worked the past few years. This is because as the petitioner for your husband, your required to file the Affidavit of Support.

If you did not file taxes due to your circumstances of living overseas then you should do the following:

You can obtain a transcript by calling (800)–829–1040 or by completing and mailing Form 4506-T (PDF), Request for Transcript of Tax Return, to the address listed in the instructions to request all types of transcript verification of non-filing, and wage/income information.

Transcripts will be mailed directly to you, and should be received within two weeks after the IRS gets your request. Transcripts can be mailed to a third party if you specify this on Form 4506–T. However, you must sign and date the form giving your consent for the disclosure.

1) Get transcripts for 2004, 2005, 2006. They will show you filed (what you filed) or if you did not file.

For the years you did not file, write a cover sheet and explain the reason.

I, Mrs. X, did not file taxes for the year of 2004 because I was living outside of the United States for the whole year and was a dependent on my husband who is not a US citizen or resident.

Date it

Sign it

Attached it to the IRS transcript for that year.

from my personal experience, allow for more time than the two weeks the IRS says. i ended up waiting a little over a month for my transcripts when doing my affidavit of support.

12/28/06 - got married :)

02/05/07 - I-130 NOA1

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.

Witht his you have to send copies of the W2s as well right? ..with the tax transcript I know you do not need to worry about w-2s or any other attachments.

...once again waiting

1 September 2009 (just over 5 months) Approved and card production ordered.

I'm not sure about the K-1. I did a K-3 and sent the copies from hrblock.com and was fine.

Maybe I just got a nice woman on the phone but I was able to have mine faxed to me immediately.
