This might be a bit premature, but we're thinking positively here!

We're direct consular filing through London, and filing a I-160 for a waiver for my husband's prior indiscretions with cannabis. We are very hopeful of getting a waiver after speaking with a very encouraging consular official on the date of our interview, and are planning ahead.

My husband's only brother has chosen his wedding date for May 2, 2008 and has asked my husband to be his best man. We are aware that my husband's medical exam for the embassy was March 28, 2007 and is good for one year. We are expecting our visa to be approved sometime in February. Obviously my husband would like to be able to be in the UK for his brother's wedding; if we travel to the USA as soon as we get our visa, will he be allowed to return to the UK and back to the USA without a problem?

Thanks for any help

If your husband arrives with a CR1 or IR1 visa, he has permanent resident status and at least a stamp in his passport to prove it. The green card will arrive shortly after arrival. So, yes his permanent resident status will allow him to return to the US as often as he likes and his UK passport will get him to the UK. No US entry worries once the visa is in hand.

A Warning to Green Card Holders About Voting

He will have a CR-1 visa with a green card...but are there 'restrictions' that we have to contend with? We just celebrated our first wedding anniversary; do these restrictions have anything to do with our not having been married very long? For some reason I thought they did...

Thanks for the help!

Once approved, there won't be any restrictions on his legal permanent resident (LPR) status. If he gets approval before your 2nd wedding anniversary, then his LPR status will be conditional. He will still enjoy all the rights and privileges of an LPR. The only difference would be, he will need to apply for removal of conditions before his 2-year green card expires.

you might be confusing the restrictions with the ones that apply to those that enter on a Fiance (K-1) visa. They can't leave before adjusting status to an LPR or by getting special permission (called Advance Parole)

And by the way...

it helps people give you a more accurate answer, and helps people starting off like me figure out how long they should be waiting. Thanks
