My stepson arrived here as a K-2 on his mothers K-1. His mother and I have since married and his 21st birthday will be in February. Is there a possibility he will be sent back if we have not applied for his AOS by that time? It was my understanding that it would not be a problem and he could remain here until we could afford the costs for the AOS.

Yes, it very well could be a problem. I'd do a search on here, there are/were some very vocal members whose children were forced into deportation proceedings because they had turned 21, and they'd actually filed AOS when the child was under 21.

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!
