"Intent To Marry" document with the I-129 submittal

Dear Readers,

I have hired an attorney to help me with the K1 visa process. In my research, it seems all that is required is a simple declaration with signature of inent to marry within 90 days upon fiancee's entry into the US. Makes sense to me. On my attorney's form, they are asking for a detailed "love story" of how we fell in love complete with the date I proposed and became engaged. We are not "officially" engaged yet but of course it is our intention to marry.

How have others completed this form and is it a requirement to have the detailed "love story" with the date of engagement?

Don't believe it's required, there is a sample form on this website that I used, you can find it in the K1 guide. Guess you could do it the way your lawyer says, but don't believe it's necessary.

There is an example:

Fiancé Letter of Intent

(petitioner’s / beneficiary’s address)

or when submitting for interview

United States Consulate, [name of country where Embassy is located]

I, (applicant’s or beneficiary’s name) , do hereby state that I am legally able and willing to marry (petitioner’s or beneficiary’s name), and intend to do so within 90 days of my arrival into the US using the K-1 visa.

When we contacted a lawyer previously he gave us a starter package..in it was this about the letter of intent:

"Describe here how you learned about Laura, how you met, how

you TWO fell in love and decided to get married - don't be afraid to

be mushy. You should write AT LEAST THREE GOOD PARAGRAPHS

here, BUT NO MORE THAN TWO PAGES."

I see now that it really isn't that necessary but I don't think it hurts to help..I certainly wouldn't go on for any more than 2 paragraphs!!!

Oh and I don't think you need to say you are officially engaged...Nick and I aren't and we will be filing before that happens!!! Just both of you saying you want to get married is enough.

You are right that for the letter of intent, there is no "detailed" love story required. But for the actual I-129F you have to explain how you met. It's only a tiny box and it basically states when you need more space, attach a separate piece of paper. I guess your attorney wants to be on the safe side. Personally, we only used the space in the box to provide an explanation on how we met, but some people want to write more. Maybe the case is a little more complicated?

Anyway... like I said, there is no story required for the letter of intent, but for the actual form, you have to provide some information on that. So if the attorney fills out the form for you, he might ask for a little more information rather than too little.

I, like many others, used the example here on VJ or something similar with success. However on the I-129f there is a question that asks you to describe the circumstances with which you met. I wrote about 1 page, 4 paragraghs, describing how I met my wife and the times I visited her.

On the I-129f, I only used the little tiny space provided. I basically said we met through a friend and I traveled to meet him in person and we had a good family time together. Also, we did not provide the letter of intent to marry when we filed the petition. We had NO problems at all. I thought we better submit the letter of intent though at the interview, for the both of us. So we used the example form here on vj. Did not provide any details, just put exactly what is on the example form. Of course everyone's situation is different, and you do what you feel is best. Best wishes!

Lawyers will ask you for much more than is needed because, frankly, they want to make sure they push your case through successfully. Some of it's overkill, though. The "Intent to Marry" document is just a really simple statement saying that you plan to marry (and have no previous marriages, or that previous marriages have legally ended)

May 10, 2008 -------> Biometrics appt date received

May 28, 2008 -------> Biometrics for EAD & AoS

Jun 11, 2008 -------> AoS case transferred to CSC

Jul 05, 2008 -------> AP Approval

Jul 09, 2008 -------> EAD approval

Jul 14, 2008 -------> EAD and AP received

Jul 17, 2008 -------> AoS approved (card production ordered)
