Hi eveyone,

Just wanted to know where I can find crimes that will have your petition refused? Some people are saying that the DOS would actually care about what my fiance did in another country? Anyone with a criminal *joking around* for a fiance. LOL

I understand that but I can't find the certain crime sthat refuse your petition. Anyone have a website?

If your fiance's crime fits the list here, you'll want to check out the waiver forum here on VJ.

ETA: First thing you should do is get the police certificate from Italy. See what it says, and go from there.

Of course they care about what your fiance did in another country! That is very important.

I am going to repeat alot of what I said in your other post. Sorry, but I think it is worth repeating.

They care what he has done, period. Does not matter the country. That is why you have to list everywhere he has lived and get police records from each resident country. I think one thing we all loose sight of in this process is that these men (and women should the case be) have no right to a visa. They are asking to be granted one. There is a long list of things that makes one ineligible. This means that the burden of proof is on you, not the CO.

There is no real way to answer what "crimes" will make him inadmissible. The law never really defines what constitutes a "crime involving moral turpitude." You should go into any interview knowing the details of ANY possible crime committed. Alot is at the discretion of the CO so maybe you will just luck out. But, I think it best to know every possible snag in your case and then be prepared. And, I would not take this lightly, however much we want to laugh off a drunken fight or simple mix up with the police. The CO also will not care if it was really his fault or not. The interview is not the place to argue his innocence. If he has a police record you are going to have to deal with it.

I am sorry if I am making this sound dire. Maybe he is clear and it will not be a problem. But, I do think you need to do some research on this and VJ is not the best place for it as most people here have not gone through the waiver process or even faced the possibility.
