New here and wanted to know if any have a fiance or fiancee from Tunisia,

Khaled and I have been together for 3 years and he proposed in 2006, I've been in Italy with him and finally came back to Chicago. We decided it would be a good idea for me to go back to school and get my MBA. So full-time student missing my habibi so much. I'm taking class in Islam and after I get my stamp an official fluent Italian speaker plan to start studying arabic.... thats going to be a toughy, but I have Khaled to help. anywhoo would love to here anyones success stories. I'm starting our K1 visa and having lots of problems not having here with me. I hope joining this forum will help me be able to focus more cause there are others that are in my shoes. Any advice would be extremely appreciated.

Is your fiance still in Italy? If so then that might make your process different (meaning he would go through the Italian consulate and not Tunisian). I think most of the stories that I have seen over the last 2 or so years from Tunisia have not been as stressful as Morocco/Egypt (where the bulk of us filed through).

Hi thanks for the reply,

Khaled, does not have his documents anymore for Italy. He did have them before but they won't renew them, not clear why. I believe because he had a lot problems in Italy so thay won't renew it. I would to investigate this further, he hates for me to worry so he never comes clean fully. I just wanted to pretend he has never been to Italy and work only through Tunisia cause Khaled does have a record in Italy. I'm stressing even more now!!

Is your fiance still in Italy? If so then that might make your process different (meaning he would go through the Italian consulate and not Tunisian). I think most of the stories that I have seen over the last 2 or so years from Tunisia have not been as stressful as Morocco/Egypt (where the bulk of us filed through).

Well you will have to get a document from the Italian police because he has lived there in the past. This will be needed at the time of the interview. I think my advice would be to definetely find out all you can regarding the past as it might come back to bite you in the process. If you know ahead of time, then you can find ways to work through it.

I know whats on there, if he has one, he doesn't know if he has one. He said he has been arrested but never did prison. He had to go to court and his lawyer was pretty good. But he and I are uncertain what exactly is on the criminal record if he has one.

If he was never charged with anything then it probably wouldn't appear. I would have him file for the police record as soon as possible. They can sometimes take a long time to get. He would need most likely to go to the Italian embassy in Tunis to apply for the certificate. Once you see what it's for then you can see if you'll need to file any waivers or if you can proceed as normal.

Just get the certificate and see what it says. No use speculating.

If he was never charged with anything then it probably wouldn't appear. I would have him file for the police record as soon as possible. They can sometimes take a long time to get. He would need most likely to go to the Italian embassy in Tunis to apply for the certificate. Once you see what it's for then you can see if you'll need to file any waivers or if you can proceed as normal.

The Italian police certificate can be obtained by mail from out of the country. We had to do this when we were petitioning. Turns out Morocco never even requested it, but that's another matter.

It is unlikely that the Italian consulate in Chicago will help you as the document is for your fiance, who is not a USC. There is a form to send by mail the the Procura dell Repubblica in Roma to get the police certificate. It asks for the current address. Probably best if his current address was not still in Italy, if he doesn't have a valid permesso di soggiorno.

Ok I'm a little confused. Is he still in Italy? Legally or illegally? The only potential problem I see is if using an address in Tunisia and the consular goes for a home visit and he's not there - it would be very difficult to overcome this. You will have to list all address that he has lived at the last 10 yrs I believe. I think that hollyw on this board might be able to help out with the "living in Europe, filing at home" even though her husband is Algerian. I guess I'm still questioning why you prefer to file though Tunisia if he's living in Italy?

Ok - I thought that I had read that he was there illegally, but they she said he didn't want to come back until the interview....just got confused. IMO it would be best for him to come back shortly after your paperwork is filed at the latest. That's just my opinion though.

Okay.

First things first.

It is not going to do you any good to pretend he wasn't in Italy for the time you lived there; aside from lying on an official form, it's going to make it impossible to talk about your relationship.. Don't even think about that.

Next:

Get the police certificate and the court records if you can. Not every crime makes you inadmissible. The 'standard' is 'crime indicating moral turpitude', and it's *roughly* the intuitive distinction we have between a felony and a misdemeanor, but the devil is in the details. (The U.S. is harsher on drug crimes than we would naturally think, and more lenient that we might think on certain regulatory crimes.)

You need to know what he was originally charged with, whether there was a plea, of what specific charge he was convicted, and what the maximum sentence could have been, as well as how he was actually penalized.

Then you need to consult with a lawyer, because immigration boards' advice are only as good as the number of members who have direct personal experience with it. Immigrate2us.net is another board that has more people dealing with these kinds of problems.

If your fiance turns out to be inadmissible, then you'll have the option of filing a waiver where you argue that relocating to Tunisia to be with him would constitute an extreme hardship to you. You'll submit that, and then some time later they'll approve or deny the waiver.
