Timeline

Okay, so my evidence of our relationship is all in Italy, I've never been to Tunisia....well yet. I moved to Italy for 3 years to be with him. I have evidence of callin him and emails to his yahoo.it account. Now, he has no residency there, now lawyers have told me its not a big deal but I don't understand how it couldn't be a big deal. He can go back to Tunisia, but I'm afraid that if I make him go back to Tunisia *which he would do no problem* but if does not get approved he's stuck in Tunisia. Is my case a lost cause? We have tons of pictures trps to florence and birthdays, does anyone have any advice? someone said I would be better off just getting a lawyer. I feel that this can be cornered some how, Like why even bring up Italy? Yes we met there but is it necessary to elaborate? How about the phone calls to an italian number as part of my evidence? I NEED HIM HERE!!! I'm a full time student receiving my MBA and I can't focus on anything, I can't sleep, this is all so stressful for me. SOMEONE HELP ME!!

I am sure someone will come along more knowledgeable than me on this particular situation, but...

Anecdotal evidence on VJ supports that USCIS rarely cares about the status of immigration (or lack of) in other countries. We have had several people come through VJ with stories like these, and I can think of one who is here in the US now having gone through the system.

Also - just as a personal aside - my husband was an Egyptian citizen living in Canada at the time of our K1 process. He was a legal permannent resident there, however was never asked to produce any kind of documentation that he was legally in Canada.

That was helpful how about..... for the interview would I need a criminal record from? Does my fiance need to prove any evidence of income? Is that only me providing information? I'm lucky that my parents are going to joint sponsor Khaled, They love him. Anyone else with some wise wisdom??

sorry, more elobarotion, how did he get to italy, did go to italy with a visa, or what, and did he has any id issue by italian government to show at the us embassy when his interview come , the most important thing that he must have his passort of his nationality to get the visa

If your paperwork shows he's lived in Italy more than the six months (Some Consulates it's one year.) stated in the Consulate's instructions, then he'll need a police report from Italy. As you've already imagined, that may be your sticking point. If he's been there less than six months, it's probably wise to get back home ASAP.

With a police report showing crimes, the nature size of the problem depends on the crimes.

Well, I was planning to put his tunisian address, like his mothers house. now a year ago, we requested a document, that they have in Tunisia that states he is free to marry. That was sent to his mothers house. Damn, I need a lawyer. Thanks for the reply

Timeline

His illegal status in Italy won't be an issue if he goes back to Tunisia. Yes, there's a possibility that he could be denied the visa and then he'd have to stay in Tunisia, but it's a risk that he'll have to take, since the consulate on Naples will not process a visa for him if he is present in Italy illegally. My advice would be for him to go ahead and get the police certificate now to see exactly what you'll be facing in terms of waivers.

LaL, they do care. I was asked to provide evidence of MY legal status in Canada (work permit). So if they could find her SO in fault of Italian immigration law, it would/could be a problem. But then again, I'm not an expert. I do know they will ask for proof of residence for both the USC and the beneficiary.

I went to see two lawyers and they both said that he can remain in Italy, until his interview since he is not a legal resident of Italy, he has to go to Tunisia for the interview. Which is fine we are planning to when he gets approved here in the USICS first. Then we'll deal , my point was I wanted to be ready for all this if I was going to do it by myself without a lawyer. But I guess I need one.

MY situation is exactly the same as yours. Exactly - going home is a risk for him and so on. However, I went ahead and applied for my fiance, which is living illegally in London and put his address in Tirana. I told them the truth about his illegal status and sent all my evidence (i only have evidence of is in britiain, not his home country albania) and we got approved, now we are going ahead with the packet 3 stuff. the only thing i am now worried about is getting the police clearance for him as he is still in london until the interview!
