Hi,

Yes you can file, but you have to sent them copy of NOA too. Look this:

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

Yeah you can, if you applied for AOS under the new fee ($1010).

Write a short cover letter detailing your situation, provide your AOS receipt number, attach a copy of your AOS NOA1, assemble the whole I-765 package, throw everything in an envelope, and you should be good to go. Be sure to read the instructions to form I-765, just in case.

Timeline:

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

i just read the i-765 instruction of page 7...on "what is the filing fee"...i don't see a k1-based category in there that is excempted in filing fee. but what does this mean...Initial EAD: If this is your initial application and you are applying under one of the following categories...which i don't see my category in there.

but has anyone ever filed the ead yet after july 30, 2007 and did not provide the payment?

From the I-765 instructions:

7. EAD Applicants Who Have Filed for Adjustment of Status.

A. Adjustment Applicant - ( c )(9). File your EAD application with a copy of the receipt notice or other evidence that your Form I-485, Application for Permanent Residence or Adjust Status, is pending. You may file Form I-765 together with your Form I-485.

...

The filing fee for Form I-765 is $340.00.

Exceptions:

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, no fee is required to also file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485 as of July 30, 2007.

I'm not 100% sure I'm clear on what your asking, but my best guess is you didnt see anything on the instructions regarding K-1 payment and you want to know if anyone filed after July 30th and didnt pay extra? If that's the case, yes we filed after. It states on the I-485 I think about the EAD being included in the 1010 filing fee. We filed for EAD along with our AOS and just paid the 1010. No RFE

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

If that's the case, yes we filed after. It states on the I-485 I think about the EAD being included in the 1010 filing fee. We filed for EAD along with our AOS and just paid the 1010. No RFE

i paid $1010 too but i did not include ead, now i want to since i already got my NOA for my AOS, but since i found that information on the i-765 instruction on page 7, i am a little confused.

The instructions in my previous post should clear it up. In a nutshell, if you've already applied for AOS and have a NOA1 from that, you can just submit a copy of it with your EAD application under ©(9) and no fee.
