Me and my fiancee has not met in person yet...but we love each other and we have decided to file our petition without meeting in person and we will pay them 455us$ .to INS ..

I want to know in case they don't approve our petition without meeting in person and ask for proof of meeting in person ..the only option is my fiancee has to fly to me and we can give the proof BUT ....do we have to reapply and pay them 455us$ again?

If you have already submitted it, the application you have submitted will be denied and your fee is gone.

You will have to start again after you have met in person and can provide evidence of that with your new application and a new fee.

USCIS will deny your petition on the grounds that you haven't fulfilled the 2-year meeting requirement. Once you two have fulfilled that requirement, you'll have to refile again which will cost another $455.

There is no "in case of". Your petition will be denied and you will have wasted $455. You must meet first.

Wait until you meet in person to send it! First of all, as others have already told you, the petition WILL be denied for failing to meet that requirement. Second, meeting in person with a pending K1 petition may actually be harder. I have seen this come up with other couples on VJ and the foreign fiance(e) has to prove that they have ties to their home country in order to get a visa to visit the American fiance(e) and they look at this a lot more suspiciously if you are visiting your fiance.

I agree with everyone here...meet first!

You might as well take that 455 bucks and burn it.

You may also want to meet in person just to make sure this is really it. Meeting someone online is wonderful, that's how I met my sweetheart but we have had 9 visits and it was only by meeting that we could come to where we are now...the decision that this is it.

There is nothing compared to being in the same room with the one you love. I would meet first just to make sure.

From the I-129F instructions:

Step 2: General Requirements

Provide copies of evidence that you and your fiancé(e) have personally met within the last two years; or if you have never met within the last two years, provide a detailed explanation and evidence of the extreme hardship or customary, cultural or social practices that have prohibited your meeting.

have you already filed? If you haven't..there is still time to meet.

Lawyers are quite expensive and I see them now as just paid proof readers, unless you really do have a complicated case.

I don't know how a lawyer could get around the fact that you two haven't met. It's pretty clear, one of the major guidelines is that you have met in the last 2 years....

And how exactly an immigration lawyer would help in this case where the OP does not meet the requirements? Meeting in person is a REQUIREMENT prior to filing, with or without a lawyer your petition will be deined.

No, an attorney cannot do anything to get around the meeting in person requirement. What they may be able to do, though, is give you a good explanation of how the process works and what you need to do. And, as mentioned, if your case is complicated by anything at all (such as having a criminal record or prior visa overstay), then having an attorney represent you through the process is very helpful.

An alternative to having an attorney file the petition on your behalf is to have a consultation with an attorney. That may even be something you can do by phone if there are no good local attorneys.

Unfortunately, depending where you live, finding an immigration attorney who specializes in family visas, as opposed to business visas, can be difficult. If you are in Seattle, you may have better luck with it than I did in the Midwest.

I am absolutely sure that if you file an I-129F for fiance and haven't met yet, your petition will be denied and you will not receive a refund.

If you want help, then help us help you. It is still unclear to us all whether you actually filed a petition already or are simply asking what would happen if you do. It is an important question. Please answer it.

At that time the fees were much much less. You did meet your fiancee in December of 2005 but didn't have enough proof?

Hmm...

I suggest you meet a few more times in person, take lots of pictures, keep the boarding passes, stamps in your passport and then proceed.
