Hi everybody,

I feel like a newbie again because I'm not sure of exactly how this AOS thing works. I've obviously looked at the guides but just want to be clear. Are these steps correct?

Send AOS package to Chicago

Wait for NOA1 (Then will I be able to look online for touches?)

Husband goes to biometrics appointment in Denver

Husband goes to AOS interview in Denver

Wait for Green card, EAD, AP etc

I just hope I am not missing something obvious. Thanks for all your help!

Jenny

Except that he may not have an interview, I think you got it right. Oh, and no AP.....that is an automatic thing with the green card. No need for AP anymore.

Sorry? AP is not an automatic thing with gc (although I am unsure what that is slated to mean).

Added in blue although there can be changes in the outline of the "list" as in, you can be transferred to CSC prior to biometrics, or even receive your gc prior to EAD & AP. Generally though, you have the right idea.

Send AOS package to Chicago

Wait for NOA1 (Then will I be able to look online for touches?)

Husband goes to biometrics appointment in Denver

Wait for EAD & AP if applied for

Husband goes to AOS interview in Denver or his file is transferred to CSC (50/50 chances either way)

Wait for Green card

AP is needed if the K-1 wants to travel while waiting for AOS to complete, There is no extra fee for EAD and/or AP if they are filed for with or after AOS. If the K-1 leaves the USA before getting green card and with out AP they will be considered to have abandoned the AOS.

NOTE: If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007,no fee is required to also file a request for advance parole on Form I-131. You may file the I-131 concurrently with your I-485, or you may submit the I-131 at a later date. If you file Form I-131 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485 as of July 30, 2007.

I meant you did not need AP after you have a green card. You can come and go as you please.

In our case, we applied for all that and got the green card. No EAD, no AP.....just the green card.

We just used the guides here and all went well, if you do file for EAD and AP with the AOS, treat them all as separate petitions with their own copies of evidence and passport pics. You can send everything to Chicago in the same envelope. One fee $1010 pays for it all.

Some times it can take years for AOS to be approved, having EAD and AP is handy for work and travel while waiting, besides they dont cost anything more.

In our case we did not file for AP or EAD, and just waited for green-card, at that time the fees were separate for the various petitions, so CHEEPED out and did only I-485 when the fee was $395.

Usualy transfer from MSC to CSC indicates NO Interview, but I have seen a few cases go to CSC, and the adjudicating officer at CSC decides an interview is needed, and sends it back to MSC to transfer to a Local Field Office for interview.

Typically, yes, but there's no guarantee. They usually transfer cases to the CSC when they think an interview is not needed, but some dude at the CSC may decide otherwise and send it back to your local office for interviewing.

Read the guide. It was a great road map and we didn't have any problems what so ever. We are getting ready to lift conditions and I am studying the guide every night :hehe:

I agree. Carefully read the guides and instructions on the paperwork and you should be fine. We filed a little bit before you, just looked at the guides and read the instructions and so far so good. Just had the biometrics Wed. Good luck and congrats on getting married :)

I don't know if its just me, but I felt more in control and felt like I knew what I was doing when we applied for the K1. For some reason, this step is daunting and I just worry that I will miss something.

You would think I would be calmer now that Rich is here and we are married and happy!
