My Fiance and I became engaged mid-October while I was visiting him in the UK. We've been discussing visa options for a good while now, but still aren't sure which one to pursue.

He's planning to visit in February, but we're wondering if the choice of visa could affect his visit. If I apply for a K-1 now, will he still be able to visit and stay for the 90 days? If we try for a K-3 and get married while he visits, would he have to leave as soon as the application was filed?

Two visa options to consider K-1 if you wish to marry in the USA and adjust status, or a less expensive option, marry and then file for CR-1 it is much less expensive than the K- Visas. K-Visas have the $1010 adjustment of status CR-1 does not.

In most cases CR-1 takes a bit longer to get than K-3.

CR-1 has the big advantage of immediate green-card upon entry allowing work and travel, K-3 needs to wait up to 3 months to get EAD to work, K-1 in most cases has to do the same and wait for 3 months for EAD.

Any travel that the US citizen does, whether inside or outside the US, is fine and does not affect the visa application at all.

I see that the CR-1 visa is much cheaper to apply for... but that he wouldn't be allowed to visit while it processes.

Would I be allowed to visit him in the UK instead?

Actualy there is no restriction on UK citizen visiting even with a CR-1 processing, the UK citizen needs to show ties to the home country, a letter from employer usually will do.

I know what you mean! Next to impossible for a Chinese citizen to get a tourist visa out of the consulate especially with a visa being processed, in this case it is up to the US citizen to do the visiting, and this can get quite expensive $800-$1500 per trip for airfare.

I'm not sure where you're getting the "not allowed to visit" information from, because it's not true. While in some cases it may be difficult to get a tourist visa while a K-1 or immigrant visa is processing (that's what these folks going through China are saying) the UK participates in the visa waiver program. As long as he is eligible for that, it's very easy for him to visit. My fiance spent almost the entire K-1 process in the US with me; now that he is my husband and we are applying for a CR-1, he has been able to visit as well. We always travel with a packet of extensive proof of ties to the UK containing things like our tenancy agreement, bank statements, council tax bills, work contracts, etc. that would be useful in making our case if we were to be questioned by an immigration officer. So far, this is not an issue for us.

So yes, he can visit you in the US no matter which visa you choose. Just make sure he can prove he's going home afterwards!

Thanks for all the info here!

I've been hearing that whenever he does get here and goes to find a job... certain places won't hire him because hes not a U.S. citizen. If he has his permanent residence and his social security number do companies (even retail places like Best Buy or RadioShack just to start out) have restrictions for that?

Are you talking about when he's made a permanent move? If so...there are some restrictions about work if you're not a U.S. Citizen, like working for the federal government, or maybe some state governments...airports, post office, things like that; however, with a GC and SSN, he'll be legal and able to work any other place.

Yeah... I mean when he's finally moved over here permanently. Someone keeps telling me he's going to have trouble finding a job because companies need some sort of contract to hire foreigners... even if they have a green card and a ssn.

Not too sure where she's getting her info. I wanted to check up on it just in case =/

This isn't true. With a GC and her SSN, she'll be legally able to work in the US, except as I earlier pointed out, some certain government jobs.

He'll be able to do just about anything besides be a cop, join the military, or work with the government in certain other capacities...even all government jobs aren't barred though. I know in New York permanent residents can be traffic agents and other law enforcement officers that aren't full police.
