Desparately missing my daughter from my previous marriage now left in my home country and wanted so much to be with me soon . I am planning to go back to my country soon I received my green card. I am married to USC and He is willing to petition my daughter to make the petition more quickly than me as the petitioner. My problem is she is a Japanese and she is under the custody's name of her father signed during our divorced. But since she is still a minor I was allowed to take care of her.But bring him back to his father during vacation . I know I need a fathers consent with this matter. My question is where can we file the petition? Is it possible? Is it in Japan or my home country where she is now? Or can she visit me on a tourist visa? is there a conflict on the immigration? Please help... (very confused mother)

Hubby can file a I-130 for anak as her being his stepchild.

I wish you pinay [My wife mainly] would get HIS, HIM, HE, SHE and HER figured out. Makes it difficult to communicate sometimes.

Your hubby would file petition at his USCIS service senter.

Not much chance of getting a tourist visa. How old is he, him, she ??

PLease don't take offense. Just having some fun.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

Japanese can use the VWP.

thanks Broiler. Yes she can enter U.S with her passport alone but maybe there will be a conflict since I just adjusted my status recently . I think ,I just have to prove to the immigration that she will come back to Japan and just stay here for a vacation. But still worried ..there's a risk of deporting her.

Actually she does, not you.

Unlikely to be deported, just refused entry.

My daughter is 5 years old and don't need to get a visa because she is a Japanese.Yes ,you are right on my situation maybe there will be a conflict upon her arrival at the airport because I just adjusted recently my status and immigration might think I will adjust her visa too if she came in tourist visa which is prohibbited by the law. I don't want to conquer any delay at airport immigration or deporting her. But ,if I will really convince the officer and show some proof to them that she need to go back home to her father,I just have to try and accept what ever happen.

Filing I-130 for her by my hubie will need a bit of patience and my question is I don't know where will do we file the petition. Japan which is her residency? or Philippines where she is staying right now? I am posting my problem to gather advice what's the best way for my daughter in order to come and stay with me as soon as possible and I am thanking you guys for all your concern and ideas. I really apprciate it .

Is there anyone who has an experience with this situation? :help:

I would go with Japan, likely to be quicker and less hassle.

Yes ,I think so  If that will happen I will just ask her father a letter of consent or a letter that I will bring her to US for just a visit and a letter that that will provide that I have to bring her back home. If everything will be alright then..in the near future I have to talk to my X husband about what's the best for her. To be with me and file a petition or to stay with his father in japan. Anyway both country will be good for future I think. And it is a matter of deciding the very best for our child.

Thanks

As you know, Japan has a reciprocal visa exemption arrangement with US. Therefore, your children should not have any problem entering US as a temporary visitor. However, we are not sure if US Immigration asks any additional document upon arrival. Please contact USCIS (http://www.uscis.gov/portal/site/uscis) for more information.

Thank you,
