My wife will be applying for AOS for me in several months. I came to the US in 1997 with my mother on H4 visa. Overstayed the visa, went to school, college, now graduate school.

If I understand correctly, I should have no problems getting AOS as an overstay (except for common problems that everyone seems to have encountered), but I have one big negative thing in my case:

I got arrested last April and now have a Disorderly Conduct (Violation) on my record. While this does not seem to fall under any deportable offenses (if I understand correctly), I'm still very afraid that I will encounter problems because of that. Seeing how many knowledgeable people are on this board, could someone please advise me on what consequences may my record have for the application and how do I resolve it?

Of course I will get an immigration lawyer, but a friendly advice and chat always seemed better, than dry, businesslike demeanor of a lawyer.

I don't think Disorderly Conduct is a serious problem, just make sure that it is reported if needed, like on forms or questions from a USCIS rep.

I don't think you'll have any problems... other than the fact it's silly to have a disorderly conduct on your record ;) I'm not aware of any "common" problems related to an overstay? My lawyer mentioned nada about mine.

Not all lawyers are business like and dry... mine is quite helpful and warm :-)

04/14/2008 Stokes interview. Approved in less than 5 mins with no questions asked.

04/17/2008 Card Production Ordered.

04/22/2008 Received Green Card.

I am not going to get into details, but I can tell you 100% sure that you will have no problemas as far as the overstay or the criminal record. Don't worry. We worried and it was barely mentioned. Just make sure you have COURT CERTIFIED COPIES of EVERYTHING, I mean EVERYTHING... my wife's wasn't certified and we received an RFE at the interview which delayed our process (as per ouir timeline - below) but we were approved with any real problems.

Since you've been through this experience already, do you mind giving more info on what do you mean by EVERYTHING (court certified)? Is there a whole bunch of things I need to show regarding this? I thought that there was just one document, which you need to show (certified, of course).

Police report, pre trial paperwork, arrest record, probation, parole, community service, anything related to the case really. You will receive a notice with your interview letter stating what you need to bring in case there's been an arrest.
