on form I-765 .... am I making this complicated?

Filed: Timeline

At the top of the form, it says "I am applying for:

Permission to accept employment

Replacement (of lost employment authorization document)

Renewal of my permission to accept employment"

He got temporary work authorization at his POE, JFK. I think he is applying for renewal, since he did have the temporary permission. But does USCIS consider this as applying for renewal? Since he didn't have to apply for the temporary one? And if we check "renewal," they renew it for longer that 90, don't they? These are such tiny questions, if someone else asked them I might have overlooked the answer.

Except for this, the form is completed.

You are applying for the first one "Permission to accept employment" because now you are applying as someone seeking AOS, not as a K-1. Make sure you select ( c ) ( 9 ) and NOT ( a ) ( 6 ). The temporay POE stamp is not to be renewed.

2007-10-17 filed for AOS and EAD

2007-10-25 NOA1 for both applications

2007-11-19 RFE for AOS

2007-12-11 received letter with AOS interview date (Feb 2008) but none for biometrics appointment

2007-12-28 EAD touched

2008-01-07 Infopass: EAD approved on 12/28, status online not updated, received biometrics appointment

2008-01-26 Biometrics appointment

2008-01-28 EAD Card Production ordered, AOS and EAD touched

2008-01-30 EAD Card Production ordered again

2008-02-20 AOS Interview, verbally approved

2008-02-28 approval notice per mail.

K-1 holders should be filing for EAD based on a pending I-485 (c )(9 ) NOT based on the K-1. (c )(9 ) results in a 1 year EAD card.

File for EAD with or after filing for AOS, the fee for EAD is part of the $1010 paid for the I-485 (AOS)

Ok, thanks. It would only be a renewal if what he had was a super official authorization requiring the filling out of an application. So the temp authorization doesn't count for this purpose. I already figured out the (a)(9) thing though, but good to hear it confirmed.

Ah, Yu, thanks "the fee for EAD is part of the $1010 paid for the I-485 (AOS)." My new hubby's friend told him that because we didn't apply for the EAD sooner, that we would now have to pay $300 for it. I thought that didn't sound right.

You only pay the fee if applying for EAD BEFORE filing for AOS, some K-3 holders do this because they want to be able to work, get SSN, and get driver's licensee prior to either returning to home country to interview for the CR-1/IR-1 as per the original intent of the K-3, or hold on filing for AOS until their 2nd wedding anniversary to avoid the conditional status green-card. K-3 (a )(6 ) EAD is also based on the I-94 expiration, K-3s tend to get an I-94 valid up to 2 years.

So Correct EAD and AP are part of the new $1010 fee paid for AOS.
