confusion on when to file

ok, my husband's gc came today and it expires in 2 yrs even though our 2nd anniversary is next june (7 months from now).

should we send in the application to remove conditions 90 days before our 2nd wedding anniversary

or 90 days prior to when his gc expires (10/04/09)?

From the first page of the I-751 Petition To Remove Conditions On Residence form:

"If you are filing this petition jointly with your spouse, you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status. This is the date your conditional residence expires."

You file to lift conditions within 90 days before the second "Anniversary" of Conditional LPR status (this is 90 days before the card expires NOT wedding "anniversary")

This is a very frequent question.

People confuse wedding anniversary with LPR status anniversary.
