K3 DCF Filing

:help: I put this in the DCF filing forum but I'm posting it here too in case someone has information. I'm a bit confused about the new DCF requirements in India and unfortunately the Delhi Consulate is no help. First I can't get an answer when I call on the phone and then when I sent an email I got a standard reply back that goes to everyone and DID NOT answer my question which is this....

The New policy for DCF in Delhi starts on June 1. I plan to move to India for a couple of months in the middle of May. I was wondering if those who arrived before June 1 would be grandfathered in under the old 60 day policy. I was also wondering exactly what they considered to be a resident...I already have a job lined up for the two months I will be there but I do have to be back in the States by mid-July.

Anyone know anything that can help me? BTW, I'm doing a K3 filing because we married last month.

You cant DCF a K3........only I-130 which in your case would be a CR1 visa :yes:

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

Now I'm TOTALLY confused. I thought that since I wasn't moving there permanently (only for two and a half to three months for an assignment for work) that I we could file DCF. Is this not correct?

You seem a little confused with the filing. You cant do direct consular filing with a K-3, just as euro said. A K-3 visa is one that gets a spouse to the US to await approval of the I-130. What you will be doing with the DCF is filing the I-130 directly with the consulate in India. Make sure you have a good read of the DCF Guide http://www.visajourney.com/forums/index.php?autocom=custom&page=dcf so you understand exactly what is filed.

As for your actual question, I'm afraid I dont have an answer for you but perhaps someone will.

one of my friend did DCF from new delhi and her visa was in 2 1/2months. which is really fast. But in order to do that you have to be US citizen and stay in india for 60 days before applying for it.

I don't know of any policy of June 1.
