I'm sure there are some people here from Florida that recently got married after their fiancee arrived here on a K1. Gemma just arrived last week and we're getting ready to go get a license but I read on the requirements for the clerk of the court page that she has to have her passport and I-94 and a social security card. We wanted to wait until after marriage to get the social security card so we didn't have to do the drill to do a name change.

I could have sworn that I read before on other web sites that people here on a K1 didn't have to have a social security number to get a marriage license issued in Florida. Could someone fill us in please.

It depends on the state. It was easier for us to get the SSN right after Claudeth arrived. If you wait until after you are married you would have to get something from the USCIS in the new name. Claudeth had to wait for the EAD so that would add several months onto the wait.

I don't understand your reply. If we get married, then get a social security number for her in her new name, we'd have to get something from USCIS in the new name? For what? Also you don't have to wait for EAD to get a social security number. One can be issued before that. If not you'd be caught in a legal document loop. You can't get married because of no social security number, you can't get a social security number because no approval for EAD, you can't apply for EAD because you're not married yet and can't file for AOS.

Yes I didn't think you'd need anything from USCIS but my original question was for any other Florida residents and if they needed the social security number in order to get a marriage license. I know some states don't require it. We'd really like to get married first then get the SSN so we don't have to go through the drill of a name change. Seems like such a waste of time and government resources.

sorry. When we went back to get Claudeth's name changed at SSA they wouldn't do it just based on the marriage license, we had to have something official (EAD) from the USCIS. SSA won't issue the card if the name on the SSA appl doesn't match the name on the visa.

I took Claudeth to SSA after she was here for two weeks to get her card because after all the reading it seems to be the easies to ensure she had a card.

Other than that I have no idea what you said either :blink:

Nope. The courthouse here in citrus county just asked for Myla's passport with the I-94 attached as identification in order for us to get a marriage license.

I concur. Here is the link to the Okaloosa County web site marriage license application Okaloosa Marriage License and is clearly asks for the SSN. The link above is from the State level and it is law.

A SSN card with the maiden name on it is a minor inconvenience in the big picture. It can be rectified at a later date.

Here is what the requirements are for Citrus County, FL Citrus County, FL Marriage License Appl. Requirements

It is a little unclear in their instruction as it does not say "OR". Only that the SSN is required and then a note about being a non-resident. Not very well written.

I guess your right, but i don't remember ever having to give my SSN when I got married here years ago.

It's no big deal. It is very possible that the county interprets that to mean that if they are a foreign national then the visa will suffice. I would certainly not make any waves about it. If they require it you will need it. If they don't ask, no problem. It looks as though Citrus County wrote some instructions that appear to fail the State requirements but nobody really cares. Investigating might open a can of worms.
