Does US recognize original citizenship?

You see, if I ask the embassy about this, they'll report me to brazilian government, saying I have two nationalities, and they'll start a process to take out my brazilian citizenship. And then after that I'd have to reapply for brazilian citizenship through another process. That's the protocol here, and would make things more complicated.

That's why I was asking the thing about US not forcing you to withdraw your other citizenship, 'cus of the law in Brasil. If it's for a fact they don't, then I don't have to do the loose/reapply for the brazilian citizenship.

And this is all discussion for future decisions, not for now, true, but I was just curious and studying the matter ahead of time.

Hi Laura, I am from Brazil as well and living in US right now.

I have always traveled with 2 passports, brazilian and italian since I don't need a visa to enter US, but I can only stay 90 days with a waiver (that little green form you fill up and give to the official at the airport). I show my brazilian passport to leave brazil, and show my italian in US, if I go back to brazil I show my brazilian one. I don't know if that helps you at all, but just telling ya how I've done it so far.

And that made me think of another question..

Anyone knows about triple citizenship?!

I am in the process to get my green card, but if one day I apply for citizenship, I don't want to give up my brazilian or italian one.

You can be a citizen for as many countries that recognize you as such. There was an individual who used to post on here that had 6 passports...

Thank you for the links. Sadly my country doesn't acknowledge dual citizenship (yet) there are some Mix Couple Groups that's been trying to lobbying the government by petitions and such to help make it possible. I'm just hoping by the time we're ready to do this they'll recognize dual citizenship. :yes:

March 2010: Officially separated after yet more affairs exposed just a day after my birthday!

February 2011: Officially divorced.
June 18, 2011: He married the girl he had the last affair with.

August 2014: I am engaged with my real soulmate. Not an American.

That list is outdated; Pakistan now allows Pakistani citizens to maintain their Pakistani citizenship after naturalization. I remember my best friend (naturalized USC born in Pakistan) showing me a letter she'd gotten from the US state department announcing the changed rules and explaining how she could go about reclaiming her citizenship and applying for a new Pakistani passport.

I've found the law from Brazil... I dont think we will have problems with Dual citizenship...

Com a aprovação da emenda constitucional 03/94, a Constituição brasileira passou a dispor no seu artigo 12, parágrafo quarto, inciso II, que:

"Será declarada a perda de nacionalidade do brasileiro que:

II - Adquirir outra nacionalidade, salvo nos casos:

a) de reconhecimento de nacionalidade originária pela lei estrangeira;

B) de imposição de naturalização, pela norma estrangeira, ao brasileiro, em Estados estrangeiros, como condição para permanência em seu território ou para o exercício de direitos civis."

Segundo o Despacho número 172 do Ministério da Justiça, de 4 de agosto de 1995, a interpretação a ser dada a essa norma constitucional é a de que:

a) no caso da alínea (a) transcrita acima - reconhecimento de nacionalidade originária -, "não perde a nacionalidade o brasileiro que teve reconhecida outra nacionalidade por Estado estrangeiro, quando a mesma decorre do direito de sangue (jus sanguinis), sendo originariamente adquirida. Aqui o simples vínculo sanguíneo é que faz surgir a nacionalidade, independente do local de nascimento. É, v.g., o caso da Itália que reconhece aos descendentes de seus nacionais a cidadania italiana. Muitos brasileiros descendentes de italianos vêm obtendo aquela nacionalidade, através do simples processo administrativo. Nesta hipótese, não há aquisição derivada de nacionalidade estrangeira, mas reconhecimento de nacionalidade originária, independente de renúncia ou opção pela nacionalidade anterior. Neste caso, não perderão a nacionalidade brasileira os que se utilizarem de tal benefício";

B) no caso da alínea (B) - imposição de naturalização por Estado estrangeiro -, é preservada "a nacionalidade brasileira daquele que, por motivos de trabalho, acesso aos serviços públicos, fixação de residência, etc., praticamente se vê obrigado a adquirir a nacionalidade estrangeira, mas que, na realidade, jamais teve a intenção ou a vontade de abdicar da cidadania originária. ... A perda só deve ocorrer nos casos em que a vontade do indivíduo é de efetivamente mudar de nacionalidade, expressamente demonstrada."

Os requerimentos de reaquisição de nacionalidade brasileira devem conter: (a) os motivos de aquisição da nacionalidade estrangeira, (B) compromisso de cumprimento dos deveres inerentes aos nacionais e © cópias de um ou mais documentos pessoais (carteira de identidade, passaporte, ou qualquer outro documento do qual constem o nome, filiação, local e data de nascimento do interessado).

I am thinking about that alinea myself, I had read that. Thing is, I took international law in my last semester of Law School and my teacher said US is not one of the countries that would be ok to get nationality from, but we do know that I can´t use all my civil rights living there without naturalizing, so it´d be in that alinea.

Oh well, I guess that in a few years, when I have to decide this, I´ll look for more info on this rule.

Funny thing is that Brasil is not on either list, allowed or not allowed. :P
