Indictments handed down in alleged Herrin beating

MARION - Three law enforcement officers and one man pursuing a similar career have been indicted by a Williamson County grand jury in connection with the Aug. 13 beating of Herrin resident Derek Wynn, State's Attorney Charles Garnati announced Tuesday morning.

Kyle Rinella, Michael Carruthers, Clinton Ronchetto and Kyle Murray are facing a variety of felony and misdemeanor charges including battery, mob action, unlawful restraint, official misconduct, reckless conduct, criminal damage to property and criminal trespass to property.

At the time of the alleged beating, Rinella was a Williamson County Sheriff's deputy, Murray was a full-time Energy police officer and part-time Herrin dispatcher, Ronchetto was a full-time Herrin police officer and Carruthers was applying for the sheriff's auxiliary.

"I'm going to prosecute them," Garnati said. "And I'd like the public to know that I've been working my tail off on this case the last two months, as has the grand jury.

"It's been quite an imposition on their lives to take on this difficult task."

Garnati has been disappointed by comments made by some that he was purposely delaying the filing of charges to protect law enforcement officials. He said he has been slow to file charges because he wanted to conduct his own investigation with the assistance of the grand jury.

"I'm going to keep digging and won't leave any stone unturned," he said. "I have reason to suspect that other people are involved, which is why this investigation will continue."

Judge Ron Eckiss issued warrants for the arrests of all four men. Bond was set at $100,000 each. As of Tuesday morning, Rinella, Murray and Ronchetto had posted $10,000 bail, while Carruthers was still in jail. Garnati's administrative assistant, Jimmy Dean, said Tuesday that Carruthers' bond had been reduced to $50,000.

"In my opinion, this is the most serious case that has ever happened in my lifetime," Garnati said. The 23-year prosecutor would not elaborate on why he feels that way.

Garnati added that anyone who has been interviewed and withheld information from authorities in this case can be prosecuted for obstructing justice.

"I hope everyone knows that," he said. "It's a class 4 felony and can send people to jail. So if you didn't know anything about that law, you know about it now. I would urge anyone with information to come forward and talk to me."

Murray is charged with unlawful restraint, a class 4 felony; criminal damage to property, a class 4 felony; criminal trespass to real property, a class B misdemeanor; three counts of battery, a class A misdemeanor; reckless conduct, a class A misdemeanor; mob action, a class 4 felony; and two counts of official misconduct, a class 3 felony.

Rinella's charges are unlawful restraint; criminal damage to property; criminal trespass to property; aggravated battery; three counts of battery; reckless conduct; mob action; and four counts of official misconduct.

Likewise, Ronchetto is charged with unlawful restraint, criminal damage to property; criminal trespass to property; three counts of battery; reckless conduct; mob action; six counts of official misconduct; and one count of obstructing justice, a Class 3 felony.

Carruthers' pending charges are unlawful restraint; criminal damage to property; criminal trespass to property; three counts of battery; reckless conduct; and mob action.

Suspect in murder at orchard pleads not guilty

Posted October 23, 2007

WATERVILLE — A 28-year-old orchard worker pleaded not guilty to murder Monday in Douglas County Superior Court.

Eliseo Aguirre Fuentes entered his plea by video conference from the Chelan County Regional Justice Center in Wenatchee during his arraignment before Judge John Hotchkiss in Waterville. Aguirre is charged with first-degree murder while armed with a deadly weapon. The maximum sentence is life in prison, but deputy prosecutor Eric Biggar said the standard range of 22 years to 28.6 years in prison is more likely because of an apparent absence of aggravating circumstances.

Aguirre’s bail remains at $1 million and his trial is set for Nov. 28, Biggar said. A pretrial hearing to determine if Aguirre’s confession was knowingly and voluntarily given has been set for Nov. 13.

Aguirre is accused of stabbing to death a fellow orchard worker, Gabriel Garcia Cabanas, 31, on the night of Oct. 6 in a McDougall & Sons orchard north of Orondo where both worked. Aguirre told sheriff’s deputies he killed Garcia because Garcia had sexually assaulted him several times, court documents show.

Worm predicts snowy winter start

The winning worm points to a warm winter with a cold close. Eleven-year-old Olivia King of Raleigh took home the grand prize of $1,000 at last weekend’s Woolly Worm Festival, and her worm, Armstrong, outraced 1,400 competitors Saturday. By virtue of his win at the 30th annual festival in Banner Elk, Armstrong became the official folk meteorologist of the High Country. The brown-and-black stripes on the woolly worm are said to predict the winter weather. According to Armstrong’s coloring, the first four weeks of winter will be cold and snowy. The fifth and sixth weeks will be cold, while weeks seven and eight will be cold with light snow. Armstrong’s stripes predict a mild spell during weeks 10 and 11, with a cold and snowy close to the winter in weeks 12 and 13. About 20,000 people were on hand for the annual festival. The worms compete in a series of heats to determine the eventual champion, and the festival has been ranked among the top 10 of its kind in the United States. Observing critters in the fall to predict the coming weather is an old Appalachian tradition. Over the 30 years of the festival, supporters say the woolly worm has been all or mostly correct between 57 and 87 percent of the time.

heres a story alot here are following from a few days ago

EL RENO — A 3-year-old girl found in a stolen pickup has been placed in state custody, authorities said Tuesday.

Alyssa Lopez was found in an abandoned pickup about 6:40 a.m. Monday on the Interstate 40 off-ramp at Peebly Road. She was unharmed.

The girl's grandfather, Douglas Gray, 49, of Kingfisher, told investigators he left Alyssa in his pickup about 2 a.m. Monday while he went inside Lucky Star Casino in Concho. He discovered his pickup missing about 3:45 a.m. and an Amber Alert was issued by the Canadian County Sheriff's Office at 5:34 a.m.

Gray, who has past convictions in Harper County for child stealing and assault and battery, had legal custody of Alyssa, Canadian County Sheriff Lewis Hawkins said. The girl was placed in state custody after a hearing Tuesday morning in Canadian County District Court. The girl's mother has not been located, Hawkins said.

Hawkins said Alyssa was able to tell authorities the man who drove the pickup away from the casino was named "Danny.”

About 8:35 a.m. Monday, Daniel Lee Green, 29, was arrested by Oklahoma City police when officers saw him walking at SE 104 and Indian Meridian Road, Oklahoma City police Sgt. Gary Knight said.

Hawkins said Green was booked into the Canadian County jail Tuesday on complaints of kidnapping and grand larceny. Authorities said they have not been able to determine if Alyssa knew Green before the pickup was stolen.

Hawkins said information about the case will be forwarded to the district attorney's office when reports are completed. Alyssa will remain in state custody at least five days.

Another custody hearing will be scheduled in Kingfisher County District Court, Hawkins said.

The stolen pickup was spotted by Newalla resident Mark Washburn on Monday after Washburn recognized the license plate number from an Amber Alert message he read while driving east on I-40.

hmm yeah, that's true. Interesting that seems to be the case all over, except in Calgary - royalty review is good, even though the oil companies are threatening to pull out of Alberta :hehe:
