Hi

We initially went through the K1 process, married and adjusted status but returned to Ireland. We are looking at moving back to the US in 10-11 months and will need to reapply for a visa (possibly K3? and hopefully DCF). I was wondering is there any second time filers that can give me some idea of how difficult it can be second time around. I imagine they will be much more strict and ask lots of questions as to why we returned to Ireland etc and any info would be helpful.

You may try contacting VJ member saywhat. He is a second time filer, 1st time for K1 I believe, and the second time for a CR1/IR1 visa going through the London embassy.

Why a visa? You adjusted status, don't you have a green-card?

If you have green-card you can be out of country for up to a year, if over that you needed a re-entry permit. If over 2 years then yes you may be looking at a new visa.

Since you are living out of the country, FORGET the K-3, file for an IR-1 (DCF) directly at the consulate, it costs much less, and tends to be much faster. K-3 AOS costs $1010, IR-1 gets a 10 year green-card as soon as enter the country.

Thanks everyone

My timeline for some reason has never shown up properly. My GC is due to expire April 10 2008, but because I've been out for over a year (only a 2 week visit in between) and never filed for a re-entry permit I could be stopped if I tried to go back with just my current green card. I could try the returning residents visa, but from looking it up -I don't think I qualify.

YuandDan, thanks I'll start researching the IR-1 visa :thumbs: and thanks for the links too.
