1-130 Petiton for infant

Hi All,

not sure if i am posting in the right forum, i will go ahead and ask these questions

A family member of mine is married to a Jamaican Citizen he is now a naturalized US Citizen, they have a 5 month old son together, my question is should he file 2 seperate 1-130 petitions (one for his wife one for the child? we contacted the Jamaican embassy about it by email, we explained to them that we are going the CR1-IR1 route, i even asked about the consular report of birth for the child, i dont think they seem to know what that is, they replied to us saying that if the child isnt qualified for the consular report of birth (which we dont know if he is or not) the husband should file seperate 1-130 petitions, what do you think we should do? any info will be greatly appreciated

Don't contact the Jamaican Embassy. Contact the US Embassy or Consulate in Jamaica. If the child qualifies for citizenship and a US passport, great. If not, file two I-130 petitions.

I think that the baby qualifies for US citizenship. I am not sure about that fro 100% but will tell you my case.

My husband (US citizen) and I were married in Ukraine and had a baby born in Ukraine. US Embassy here issued our baby a US passport and Report of Birth Abroad. So we had to file only one I-130 for me.

I agree with checking with the US embassy in Jamaica. Went through similiar situation in Guyana recently. Went to embassy got forms for consular report of birth, also application for passport. Fill it out, and then take it back to embassy with baby. It also best if both parents and baby go. Web also has most forms which are fillable pdf etc

Oct 16 07 - Called USCIS - No NOA 1 Recieved - Told it was never mailed and they will now send it

Jun 12 07 - ACTUAL receipt/ priority date on NOA 1

Nov 15 07 - Touch

Nov 16 07 - Website = Approval Notice Sent on Nov 15

Was in AP @ NVC for almost 3 months

Feb 18 08 - DS 3032 & AOS Fee Bill Mailed

Thanks for all the info really apreciate it, i will ask my family member to go to the US consulate in Jamaica and speak to someone there, since we emailed them we havnt got any concrete info. will let you no what happens
