AOS denied by local office, but never recieved appointment letter

I got a letter in the mail today from the field office director, Las Vegas, Nevada stating that my wife did not show up for her interview. It says that they mailed us a letter on 12Aug, but we never got anything and the USCIS website did not say anything about a letter. It says at the end that we were provided sufficient notice and the application is denied!!!! i called the uscis support line (what a joke that is) :wacko: and they told me to file an I 290B and write Service Motion to Reopen at the top, and mail it to my local office stating i never got a letter in the mail. Does anyone else have any advice for what i can do? Thanks Shawn :help:

I have no idea about what your options are, but I would suggest making an infopass appt at your local office and go talk to them directly. We all know what misinformation the USCIS line can give out...

I don't know what's the best option for you, reopen maybe the fastest way if you can prove you never receive the letter. Did you hire a lawyer for your case? If not, consulting with a lawyer may be the best thing to do at this stage, as appealing or reopen or refile seemed to be the possible options. I'm sorry to hear you missed the last step in getting the greencard, you may want to spend couple hundred dollars consultation fees to get the professional opinions.

My case was denied too due to lost of a RFE they sent. but because it was still early in the process, so I chose to refile. For you, since everything is done except an interview, reopen or appeal may be a better choice for you.

05/05/2007 - Biometric Appointment

08/23/2007 - Request status update on I-765

09/10/2007 - Response of Service Request on I-765 received: I-485 and I-765 denied on 08/28/2007

09/12/2007 - Denial Notice Re-sent (original lost in the mail)

09/17/2007 - Denial Notice received. I-485 and I-765 are denied due to lack of response to RFE for medical exmination

09/24/2007 - 2nd RFE received to submit original birth certificate of US husband as I-130 evidence

09/25/2007 - Re-filed I-485 and I-765, along with I-131(with attorney involved)

09/27/2007 - 2nd RFE evidence sent

10/09/2007 - 2nd RFE response received by NBC, I-130 resumed (60 days estimate for a decision/update)

10/10/2007 - NOAs issued, check cashed

10/15/2007 - NOAs for I-485, I-765 and I-131 received

10/15/2007 - I-130 approved!! NOA on its way

2/22/2008 - AOS Interview; received Welcoming email from USCIS on the 25th, green card on its way. yeah! :)

Please do a search on VJ for topics similar to your case. There was a time that several VJers were sent denial letters because of failure to appear for interview even though they did not get the appointment letter. You'll probably get a lot of good information on how they dealt with their situations.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

You guys are not gonna believe this!!! I made an info pass appointment for two weeks from today. I printed it out and took the denial of adjustment letter, and the info pass, along with my wife’s id and passport to the office. Somehow I was able to show the security guard my info pass, and letter of denial, and he let me in, guess he didn’t look at the date. Also I waited in line at the window to talk to the immigration officer, I showed him the letter that said I was denied along with my I290B motion to appeal, and he hand wrote me an appointment number on a sticky note and said to go to the window when called.

Once at the window they I told them my story, that I didn't receive the notice of appointment and she pulled my file. She looked it over, and told me to write a brief explanation as to why I wanted another appointment. I showed her the explanation on the back of the I-290B, and she photocopied it and said they will set me up another appointment. She also gave me a # to call their office and check on the appointment. !!!!!

So I Sneaked pass security, passed the immigration officer appointment guy, and to the supervisor who reopened my case and scheduled another AOS interview!!!!!!

I received a letter today saying that the case is reopened and the i will be receiving another interview letter shortly !!!! :dance: thanks to all the visajourney ppl who are so helpful, I would have never figured this whole process out without you - thanks Shawn
