My sister in law got in fine, visiting my husband, who was illegal.

Point being, it doesn't always matter, but people from the Philippines have a hard time getting in on tourist visas anyway, or even getting a tourist visa, period.

As for the adjusting, speak to a qualified attorney. I know overstays can adjust through marriage, and what Kez says sounds reasonable, but a lawyer is always a good idea.

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

Thank you so much guys... You are so helpful.

I know I read in the other website's forum that somebody came here as K1 but did not marry the guy and marry somebody else but I read too in the USCIS website that my wife is ineligible to Adjust here Status since she came here as K1 and did not marry the guy. but four years ago before she was out of status she consulted an attorney (who took our money) to file a T visa (drug trafficking) since my wife's ex fiance was involved in drugs , alcohol and lied about it and afraid get raped becasue ex-fiance's brother was living with them and one morning his brother was powndering the door to their asked my wife to pee on a small bottle so he can pass the drug exam for a job. So before they married she flew out from his house fear of her life.

After they file the USCIS wanted more evidence to prove (my wife told me that when she escape the police was involved but somehow there is no file in place) but the lawyer whom we apid full is nowhere to be found and that is why we did not file any AOS at all becasue we are afraid we get screwed up by a lawyer again.

That is filing an I-360. There are charitable organizations that can help with that for free. I think you have to be married to that person to qualify but I am not sure.

Now do you think if we filed AOS concorrently with I-130 and attched the I797 receipt from the T visa we can adjust her status here. And my wife graduated BS Communications Engineering in Philippines so she really want to go back to school and take some classes to pursue it here her engineering degree becasue she has to take some classes here in order to be credited.

Please help .. desperately. We are thinking of having a baby but my wife is afraidt becasue it may end up like those people who were separated becasue the mom has to deported.

thanks a lot! I hope my wife can adjust her status her without her going back to the Philippines so we can start a famil here.

I know i read in the other website that somebody apply a AOS as K1 marrying another guy but I don'e know how they do it.

It's been four years and I know it must be really hard for my wife.

So what do you think? Do you think we shouls just go ahead and apply AOS with I-130. I am really desperate please help.

Dont think her parents stand much of a chance of getting a visitors visa to come and visit someone who is illegally here in the US... you need to go and talk to a immigration lawyer about sorting out your wifes status.... you may be able to do AOS without her having to leave the US but only a good immigration lawyer will be able to look at your case and give the best advice for you.....

NOPE there is no possibility to adjust status from a K1 if you did not marry the original patitioner. It has already been argued here on VJ. The only way is to return to her home country.

Sorry but I have to beg to differ.... I know of 2 couples that I met here in Boston who were at their interviews at the same time as us, both were doing AOS after entering on a K1 and not marrying theperson who filed for them, they stayed in the US and married years later and both of these couples were approved the same day as us.... so please dont tell everyone that they cant do it.... much better to advise a visit with an immigration lawyer and let them look at all the facts....
