NSEERS

Ahmed just got a letter the other day stating he must appear to register with NSEERS. From what I understand this is really only supposed to apply to visitors from certain countries (most of which are ME/NA and south Africa). But K-1's are techinically lumped into this category because of the 'non-immigrant' visa. It is also my understanding that this registration was supposed to be done at the POE, but given the screwball who entered Ahmed's DOB as 1928, Im not surprised. Ive read all this stuff about how he has to be registered and must present to a border patrol officer for each entry and exit from the country and can only pass through certain POE's. What is this stuff? Has anyone else been put under these restrictions? I havent seen it mentioned much.

Idir received a RFE for proof of registration with NSEERS for the EAD and AP application. USCIS told us to send in the NOA1 as evidence of AOS status an NSEERS would ntobe a requirement. We did, but the green card was ordered for production and we never heard if what we sent in for the RFE was sufficient.

Who called him for NSEERS? Was this a RFE? Or did ICE or DHS send out a notice telling him to appear?

We got a letter from USCIS stating he must show up at the office where we filed for AOS via the DORA program and register for NSEERS. No phone number, no explanation, no nothing. Since we filed DORA, we were specifically instructed not to file for the EAD because it supposedly would have taken the same amount of time to process as the I-485 and would have been redundant. Im not sure how much that has to do with the NSEERS, if anything. We've never gotten an RFE, so Im not sure if this is what it is. But it does say failure to appear could cause his case to be denied, so Im assuming he has to do it to get the I-485 approved.

That's really odd. You and I are the only ones I know (and there are tons of MENA fiances from these countries) that had this problem and yet we used different POEs and filed with different locations. Definately they failed to register both at the POE which is the normal proceedure now.

The EAD is given to many non-immigrants and USCIS RFE'd us for that. The AOS was in California at the time. I suppose we are lucky the green card came through without having to worry about NSEERS- so maybe we were lucky? The USCIS office told us to send the AOS NOA1 as proof not to register for the EAD RFE.

This is so crazy. WEll the best thing then of course is to go and if you have to register, register, but know that NSEERS does not apply to Green CArd holders so all of it will be null and void once the card comes.

This is good to know. I cant see how bucking it is going to help us, even if it doesnt seem consistent with other folks cases. Im just wondering where they come up with some of this junk, it seems so random sometimes. But Im glad to know we're not alone.
