We're in the process of K-1, now filing the I-751 to lift conditions and get the 10 yr. green card. I have to mail it early Nov. But I am now looking at my husband's Canadian passport and am wondering what we do when it is time to renew that? We live in KS, I'm a U.S. citizen, he moved here from Canada on the K-1 visa and we've been married for over 2 years now :-)...... Does he keep getting his Canada passport renewed when he has status here as permanent resident? Or does he become eligible for a US passport? At what point does that change, or does it? I'm really foggy on this and our local passport place where I filled out my forms to get my US passport didn't have an answer for me when I asked them this question.

If we renew his Canada passport, can that be done through the mail, or does he have to be in Canada to do that? And do we have to send in his current one?

Thanks for your help!!!

L.

Due to the upcoming US border crossing regulations your husband is best to keep his Canadian passport valid. He can download the application for a new Canadian passport (they are not renewed, they are re-issued) at http://www.ppt.gc.ca/usa/index.aspx?lang=e. He needs to send his completed application along with the requested supporting documentation (birth certificate, photographs, fee, and completed guarantor responsibilities) to the Passport office address listed in Quebec. If his current passport is still valid, he needs to include that passport with the application as well. He can request to have it returned after it is de-activated.

Your husband will need a passport if he plans to do any travel outside of the US via plane, including if it is back to Canada. He will also be required to show his passport along with his green card on his return to the US. US citizens also are required to have a passport to re-enter the US by air, and passports will be required for all individuals entering the US via Canadian land ports of entry effective June 2008.

Your husband is not eligible for a US passport until after he has applied for and been granted US citizenship. He is eligible to apply for US citizenship 3 years after his green card was granted as long as he is still married to you, the US citizen; otherwise he would have to wait until he has had his green card for 5 years.

Hope that helps.
