K3 -Waiting in US while applying for adjustment

Timeline

I am from the USA, I am engaged to a man from the UK. I spoke to an immigration attorney who told me the easiest way to bring my fiance to the US would be to bring him here on his Visa Waiver, get married, and immediately apply for adjustment. Yet I see the forums and information for the fiance visa. Can anyone advise? Is doing it the way he suggest legal? Is it the fastest way to bring him here? What are the risks of doing it this way? Thank you,

Approximate Timeline:

Me: Lives in Massachusetts, USA

Him: Lives in Scotland

Met: July 5, 2006 online in Second Life

Met real life: November 06, 2006

Engaged: December 8, 2006

First visit face to face: 83 days-11/06/06 to 01/22/07

2nd visit face to face: 30 days 04/19/07 to 05/17/07

3rd visit face to face: 42 days 9/25/07 to 11/08/07

Contact: Daily average 4-8 hours online, on skype, and by email.

Plans: To marry in 2008

My fiance received divorce decree 2 months early! Decree completed 2/11/08

Plan to begin filing of K-1 in July of 2008! Currently gathering documents, studying information, and preparing to file!

Your lawyer is sugesting visa fraud, use of the VWP with the intent to immigrate. If USCIS becomes aware of the fradulant use of VWP, they can simply deny the AOS, and deport, and place a bar on the non citizen, the couple will then be filing for the correct visa (K-3 or CR-1) and also have to file a waiver when it comes up at the visa interiew.

Since you already know your future spouse, and are discussing immigration, the you already have immigrant intent, do the right thing and file for a K-1 visa and enter the country the right way and then marry and adjust status, we did, and are glad we did.

UK is much quicker for K-1 visas than in our situation with China.

Yeah, we've been hearing of quite a few lawyers recommending this kind of visa fraud. People do get away with it sometimes but I don't advise trying it.

Lawyer is correct. Fastest way!

However he may be looking ahead for more bucks trying to keep you from being deported if the AOS is denied.

Sure not worth the risk. Ain't no guarens short cuts.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

One thing about this sort of advise from lawyers that I have noticed is that they dont often mention the consequences if your application is denied. You have no recourse other than leave the country and try for a IR visa basically. It is illegal to enter if planning to immigrate on a visitor visa.

For myself, I would never risk anything even though I know that it is only a small risk.... it is still a risk.
