We just got our interview packet, October, but I just mailed my tax return in.

We filed tax married/jointly and our CPA did not know the process so filed and extension in order to research the issues. So we did'nt get our tax returned mailed in until early October.

But we received our packet yesterday and it says they want an IRS waiver or the last years tax return.

Since it is obvious I'm not going to get my tax return for some time, because my it was mailed in october and it will take time, maybe, for the IRS to give her a TTIN.

So, do we need to ask to be reschedule for some time after we get our tax return?

If so who do we contact to get rescheduled?

Send in a copy of the ITR you filed plus W2s or 1099s if self employed.

No need to wait for tax "return". Only get one of you are getting dough back anyway and USCIS cares less about that.

Never have figured out why it's called a return[[iTR]!! Should be called a fileing.

OOps Send her the ITR copies.

Faxed or scanned are acceptable at USEM. Don't even have to be signed!

If you get the ITIN before the interview she can just write it on the ITR.

At least that's what we did and it "flew".

Huh? If your CPA filed your tax return, just get a copy from the CPA. There's nothing to wait for. Make sure you include all supporting documentation such as W2's or 1099's.

Really, you should have your own copy. Just make a copy of it and get it to the visa applicant.

She doesn't need the updated I-864 and supporting documents until they are asked for at the interview. You timeline indicates CR1 with an interview scheduled, so I take it you already filed an I-864 when NVC asked for it.

Yes we only filed an I-130 no fast track stuff. I'm not certain about the dates on all these items because our immigration lawyer took care of it all. I just signed papers LOL. But the lawyer started processing paper work in Dec 2006. But I know the I-864 was mailed in on or about July 12, then it was sent back with errors in Sept 10, then mailed back about Sept 15. Not exactly certain about all the dates, easier to let the lawyer handle the hassles, besides I have to make a living and pay for everything! LOL!

Send everything but a tax return is more than a 1040. I already indicated you should send the full tax return including W2's etc. Time to be precise. You're almost there. Did your attorney send your 2006 tax return with the I-864 back in July? They must have if you have an interview scheduled.

You have two options of paperwork to use for Affidavit of Support:

1) Photcopy of the actual filed 1040 form with copies of associated supporting tax papers.

2) IRS Transcript

You have enough time if the CPA gave you copies for your records.

What is the IRS Transcript?

My 2006 Tax return was not sent with the I-864 only the copy of the Extension of Time form. Because the CPA was researching requirements for filing as married/jointly with a foriegn internation/non resident. But they finished the form in late Sept and I mailed it in.

I'm a little confused here though: do I need to send my wife the form we filed with the IRS to get my taxes or the actual copy of what I get when they return my taxes? Im not a tax guru so be gentle with... thx!

My wife just mentioned she has not medical records, she lives in Bicol region. So she is worried about her medical interview. The town she lives in, Iriga City, evidently lost her records and she does not know what to take to the medical interview. Can she just get all the shots at the medical review? Will this take more than a few days? She is pregnant too, will this slow our process at the medical review. We are both concerned now... ???

Great! Between the CPA and the Immigration packet we received my brains are scrambled. The packet requests my "2006 Tax Return" and I was under the impression they wanted a copy of the refund reciept. But your suggestion gave me reason to pause and suspect the requested "2006 Tax Return" was simple, the forms I filed, not the returned reciept.

Warmest regards,

Thanks for your help, Salamat po!
