My husband and I bought a house about a year ago. Because he had only just started working at the time and had no credit history, the bank recommended that the mortgage be in my name only. Because of this, my lawyer mistakenly put only my name on the title as well (even though I requested he put both of us on it). I completely forgot to contact him to get this changed, and we are getting ready to send in the AOS forms now. Will this be a problem? We do have lots of other proof showing that we are married, as well as insurance bills with both our names at our home address. It's been so long since we've had to do this paperwork stuff that I'm starting to get nervous again! :blink:

23 Jul 2005 - Wedding date! Traditional church service, reception, etc. planned (We tempted fate a bit by planning before we had the visa, but it worked out!)

I didn't put Claudeth on my trust dead but she is in my living trust and will so will write a letter of explanation.

Your lawyer should be able to quickly arrange conveyance of the deed from you individually to both you and your spouse. Regardless of whose name was on the mortgage, this was his mistake. So he should not only do this quickly but also free of charge. *cough*malpractice*cough*

It's worth your while to wait the few extra days it takes to remedy this before sending in the I-751. Proof of joint ownership of the home is one of the most important pieces of evidence. The only more important piece, I would say, is the birth certificate of any children.

Hell, I am the Brit and I bought our house here long before we got married, so no mortgage and only me on the deed. It is still even in my maiden name!!! I am just hoping that other evidence will suffice. Not had an RFE yet (touch wood!)
