I'm getting depressed...I made a copies of original documents that NVC asking transalted everything and notarised everything.. somebody tell me if it is enaugh??or what else need to be done with them?? my 129-F has just been aproved and I'm so stresed because of NVC and all those ridiculous changes they are making all the time, that I'm thinking to continue that k-3 and finnaly go to my husband.. If it would be possible to come back for CR-1 interview later? what are my options??because after year of waiting I'll need some medical help soon..

Hi gutelt,

No use being stressed, just need to submit exactly what they ask for and hope for the best :) .

For the documents:

You must send in the Originals plus the translations:

The applicant and each family member who will accompany the applicant to the United States will need to submit the following original documents or certified copies of the documents listed in this section from an appropriate authority (the issuing entity).

All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations.

The translation must include a statement signed by the translator that states that the:

Translation is accurate, and

Translator is competent to translate.

So if you have the documents they have requested and you have the translations as outlined about, you should be fine.

As far as pursuing the K3 instead of the CR1 or coming back for the CR1 interview later - I'm sure someone here will come along with an answer to that.

Good luck to you and you can always check the document requirements for your consulate here: http://travel.state.gov/visa/immigrants/info/info_3176.html

Certified copies- notarised copies? Do I understand everything right?

You have to send the Originals.

They will return them to you at the interview.

They won't accept photocopies that you get notorized. I think another member - believe it was Nutty? sent certified copies and he got an RFE. They specifically say originals.

I think Mononke said, in countries such as her own where notaries are authorized by law to certify copies, notarized copies are accepted as certified copies. This means the notary, being a public officer of the respective government, is making the copy certification as an appropriate authority. However, if a third party is actually making the certification and the notary is merely administering an oath, then notarized copy is not acceptable.

It is possible if you specifically and clearly indicated on the I-130 petition that you wanted to pursue consular processing irrespective of whether a K3 visa is subsequently applied for. Otherwise, USCIS will hold the petition for adjustment of status rather than sending it to NVC. However, if you didn't make that clear on the petition, you can also file Form I-824 with fee after its approval to get it transferred to NVC and pursue consular processing, but it will cost you $200 and there will be an additional delay.
