Help with Request for Initial Evidence (I-485)

Yesterday I received Request for Initial Evidence for my I-485. It says to send in federal income tax returns, W2s, 1099s and letters from employer. The problem is that I did send all of these forms. The only thing I can think of is that I didn't have transcripts from IRS, I just sent copies from e-file system my wife used. Everything is a little complicated because her 2006 tax return was filed jointly with her ex-husband and they got divorced early in January, so the tax return is not in her current name. But I did submit her divorce decree and all other necessary paperwork, so USCIS can figure it out.

So my question is, should I just resend these forms again because they lost them or I have to get transcripts from IRS and send those?

And another question on my mind is, the request includes the line "You are ineligible for interim employment authorization pursuant to...", does this mean that my application for employment authorization (I-765) is also held because of this? And if it is, do they really hold it for 90 days after submitting requested evidence? Isn't there a way how to speed that up? Our financial situation depends on me starting work as soon as possible... :(

Many times they'll send a RFE for stuff you've already included in your original submission. Don't dwell on why they are doing it, just make copies of the tax returns W2s etc and resend them to USCIS asap.

And yes, they are holding processing of your EAD until they get the RFE info back. Since your EAD is based on your AOS, they won't continue to process until they have the information. So send it in quickly! I dont believe they'll hold it back for the 90 additional days. But overall EAD does take about that long to be processed from filing. Ours took around 65 days to get the card (but we didnt have an RFE).

YOUR I-765 IS "NOT GOING TO BE EFFECTED BY YOUR I-485 AS LONG AS YOUR I-485 IS IN A PENDING STATE

YOU HAVE 87 DAYS TO SEND YOUR RFE BACK TO USCIS...IF YOU DONT THEN YOUR I-485 WILL BE SUBJECT TO DENIAL AND NO LONGER IN A PENDING STATE. "YOUR I-765 IS NOT BEING HELD UP."

Several threads reported that the USCIS requested documentation that was already provided. Give em what they want........again :blink:

your RFE is exact repeat of what we got. I also filed only printouts of my husband's E-file taxes and I did not submit W-2 copies at all - not very smart but...hey! ;) However... I sent them back E-file copies again, added W-s and tried to "forget" the thing about "You are ineligible for interim employment authorization pursuant to...".

3 weeks later my EAD card was ordered! Hope you get yours as fast! Good luck!

PS

I still think that your wife and my husband should have IRS copies of their taxes, like most people do, as we are bound to get to a stage where some office won't accept just an E-file copy. I took care of it by calling IRS and got last 4 years in mail few days later!

EAD - 18 October '07 - hard copy: valid from the date of 1st notice of card production

SSN - 30 October '07 (married name), applied Oct 18, same day I got my EAD

DL - 11 December '07 - driving test at DMV San Francisco. Yay! Now I can drive on the "wrong" side of the road!

Send tax transcripts as they carry more weight than ITRs. You can get them in a short time. Especially if you have them faxed to you from IRS.

Better yet send both.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Tax transcripts are IRS documents you can order via phone and get them faxed or mailed to you. IRS doesn't charge a fee for them, while they charge $39 per copy of Tax Return if that's what you want.

And what would you send if you were sending "both", which is "better"??

ITR =s Individual Tax Return. That's what you submit to IRS for your taxes. Normally form 1040.

Tax transcripts are copies of ITRs that IRS received and are much better as they prove you filed your ITR.

People can make out a ITR and submit it to USCIS without having submitted it to IRS. Yeah it's illegal but can be done.

Can't fake Tax transcripts.

Bottomline tax transcripts are MUCH better to submit than ITRs. No need W2s with them also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
