Hi all, just to let you know, Jim & I filed the I-129F (after I130 filing and NOA1) for the K3 visa on Oct 2nd, they received it on Oct 5th and we just received our NOA1 effective Oct 17th! Good news for the rest of you, they're on their way! Finally, some good news and progression!! Good luck everyone!

Congrats to You and Jim , that's great news :)

I filed the I-129 on Oct 11th to CSC and received it on Oct 12th so hopefully my NOA1 is on its way :)

Lets just hope NOA2 doesn't take too long

I sent my I-129F on October 3rd and it was delivered to CSC on October 4th. I received the NOA1 on October 17th with a receipt date of October 11th. :thumbs:

I had read on several forums that there is a huge delay receiving the receipt. Needless to say, I was very pleasantly surprised :dance:

Just as a note -- the receipt delay is on the I-130s. The I-129f seems to be progressing a minimum of 2 months ahead. We filed our I-130 on August 15, no NOA1 received yet. Filed our I-129f on September 16, and received our NOA1 on September 18.

Still no check cashed on I-130 as of yet. By the way -- they were both sent to the same processing center -- Vermont.

Hmmm....I don't understand as you start with the I130, then when you receive your NOA1 from that, THAT is when you submit your I-129F with a copy of the NOA1....I'm confused....lol....

I sent my I-129F following I-130 at CSC on August 14, 2007. Until now I still haven't got my NOA1. Now what? I'm getting really worried I can't sleep!! :help:

05/07/2007- I-130 Sent to CSC

08/14/2007- I-129F Sent to CSC

Did not receive NOA1s for both had to inquire for Receipt #s

Both applications currently pending

I have been asked quite a few questions on how I was able to file our I-129f without the receipt notice or NOA1 for the I-130. This procedure worked for us and may not work for everyone; however, if you are willing to take the risk, it may be worth it. I am not a lawyer and please do not take my word as the "truth". I am only explaining what the instructions say.

Okay, I will try to explain and hopefully this will help others.

Here are the instructions for the "evidence" they want you to send in showing that you have filed the I-130. These instructions are copied directly from the instruction form for the I-129f.

PAGE 4:

"8. How Do You Use This Form for Your Spouse Seeking Entry With a K-3 Visa?

This form may be used to obtain a K-3 visa for your alien spouse. Fill out the form as directed, except assume that "fiancé" or "fiancé(e)" means "spouse." Answer Questions B.17 and B.18 by stating "N/A." Note that filing this form is only necessary to facilitate the entry of your spouse as a nonimmigrant.

You must submit the documents required in Items 1, 2 and4 of the instructions, but may omit the documents required in Item 3. In addition, U.S. citizens petitioning for K-3visas for their alien spouses must also include evidence that they have filed Form I-130, Petition for Alien Relative, on behalf of the alien spouse listed on this form, and a marriage certificate evidencing the legal marriage between the citizen and alien."

Please note that Nowhere in this paragraph does it state that your evidence has to be the NOA1 for the I-130.

Here is where people are getting confused because of the change in address where you mail I-129f now compared to before when you used to send the I-129f to a lockbox in Chicago and your I-130 was mailed elsewhere. In addition, there is some confusion because I don't think all of the Service Centers now are processing the I-129f so they just want to know where is your I-130 sitting.

Here is the paragraph I am referring to that is getting people confused:

PAGE 5 – SECOND COLUMN

"B. Form I-129F Filing Locations for K-3 Spouse

If you are filing an I-129F petition for your spouse, mail your petition to the Service Center where the underlying I-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F."

If you mailed your I-130 to Vermont and your I-129f address is also Vermont, then both petitions will be filed at the same location.

Here is what I did: I filed the I-129f and when I attached my documents, I put a cover sheet on the front listing what my attachments were. On Item Number 2, I put "Evidence of Having Filed I-130 -- Copy of Return Receipt from Post Office and Copy of Fee Payment Paid by Personal Check." I then wrote a sentence that said "Per conversation with USCIS, this is the only proof I have as check has not been cashed yet and NOA1 not issued yet."

On Item No. 3 as my attached, I put "Copy of I-130 filed on August 14, 2007."

They accepted every bit of this. The worse thing that can happen is that you get some person that is in a bad mood and they reject it and send it back to you. However, it is a chance we should be willing to take since it has now been over 2 months and we are still waiting for the NOA1 for the I-130.

Good luck to you! Our I-130 NOA1 took 51 days so I'm sure yours will be on the way soon! We're not willing to take the chance or any chances....we're submitting more evidence than they ask just to be on the safe side and hopefully lessen the waiting time. Hoping NO chance of any RFE's at ANY point. I've heard of people that have gone by the exact instructions and have given more than required and they've gotten thru WITHOUT an interview! I'm hoping for the same! Fat chance but nevertheless, there is a chance...

JMRJ....We are absolutely SICK for you! Unfortunately, you can't even get an answer unless you wait 6 months! That's absolutely ridiculous! our thoughts are with you! Jim and I are wondering if maybe you should submit AGAIN! sure wouldn't hurt anything and there's no cost either....make sure you send it Certified/Registered so you have a tracking number to see exactly when they receive it....good luck!!

I saw the part that you highlighted. However, the reason they say this is because they are basicaly saying" file it at the Service Center where your I-130 is pending. Prior to August 1, 2007, there were 4 service centers processing -- you might have sent your I-130 to Nebraska, they might have transferred it to another service center. That is why they are saying this.

Has nothing to do with the "evidence" you submit showing that you have filed the I-130. We did file both applications at the same service center. Our NOA1 said" We received your I-129f petition on September 18 and you have asked us to waive the fee and we have done so."

Like I said before, this may not work if you are not filing both applications through the same service center and if you filed prior of August 1, 2007 since the service centers are processing different applications now.

hi guys! seems that the 129f is acknowledged faster than we thought... sent ours last 11th of oct.. and says online noa1 was generated 15th, but noa1 copy said on the 16th! amaZING... took just 5 days to send noa1.. we recvd it on the 19th...

May 02, 2008 - visa in hand, had the CFO stamping done at once, bought ticket online...

July 24, 2008 - received package

July 29, 2008 - NOA for AOS and EAD

Aug 01, 2008 - Touched....

Oct 01, 2008 - Received EAD
