Spontanious Wedding while K1-process??

Hy everybody,

I`m new here and i already have my first question..my USC Fiance and i sent the I-129F off in the end of July this year.

We received are NOA 1 in August, and since then case status hasn´t changed,what is normal because of the current processing times, i know..

Now my question is, since he finally found a house where we gonna live in, actually everything what we planned is done...Now we are just waiting for this whole process to be over as fast as possible.

So yesterday when we talked on the phone, we had the idea of maybe getting married spontanious. The idea was that i will visit him (i have a b2 visa) for a week or two and then we just decide "spontanious" that we don´t want to wait anymore and get married during this time.Would that work?or would we get problems? or should we just wait until i get the visa??

I already have been there for 180 days this year, so the full six months,which are allowed. So another question would be, if they let me in when i go there, let`s say maybe january??Cause i`m only allowed six months each year..

Thank you for all ur answers, maybe it´s a silly question but i just wanted to know if this could work...

Get married, but then throw your K1 visa away because you will then have to reapply for a K3 which will take as long, if not longer.

Completely agree with Jamie on this one.

If you get married, you'll have to return home and file the K3.....

Don't worry, you'll be together....easy for me to say huh....

No, because you are there on a visitors visa...coming in to the country on one of those and getting married (even if it's spontaneous) is frowned upon. They could even consider it fraudulent. You will have to return home and file for the K-3 Spousal visa....

I don't even know if they will let you in the country on a visitors visa once you have started the K-1 process without showing strong ties to your home country and your plans on returning there.

Get married, but then throw your K1 visa away because you will then have to reapply for a K3 which will take as long, if not longer.

I would just wait it out. If you get married now u will have to start back at square one. K3 may take longer than even the K1. So hang in there. I waited 3 months for my noa2. My process took just 6 months thats not too bad i know it can be stressful missing your loved one.

You are planning on coming to the States on a b2 Visa with the intention of marrying. You will not be able to stay if you get married. Coming to the US on a visitor visa with the idea of marrying is fraud.

Stick with the K1.

You will open a can of worms if you marry.

Not much difference if you can be with him anyway with your tourist visa. You'll have to start all over if you marry.

You will be starting all over for a new visa this time for a CR-1 or K-3 visa, the K-1 in process will be a big red flag if you try to visit, mary and try to adjust status.

Good choice. I wouldn't want to jeopardize my chances of being with the one I love and doing that, would definitely mess up the whole thing. Be patient...nothing good comes easily.

Im going to slightly disagree with current theory on this. My mother married a German man about 2 years ago. He came to visit her on a tourist visa and basically what they did was after they married was file for an AOS. My mother talked to a border patrol agent she knew and he told her just to tell him to lie low and dont cross any borders while the AOS is being proccessed. ALso myself in my situation i HAD a fililpina fiance I talked to an Immigration Attorney and he said if I could get her to the States on any type of visa tourist, bussiness, just any that he could proccess a change of status for her as soon as we married. Like someone above said its frowned upon by the feds but its somewhat of a loophole in the law. As for me i just decided to get married in the Philippines and we are going through the K-3 process but i dunno i would give it a lil thought. It can be done my mothers example is proof.

Sure it can be done but "laying low" and trying to get in on any type of visa to marry is fraud. I believe in playing on the safe side....not saying it can't be done but if found out, banned....I would never risk my relationship like that just to save a few more months of being apart.

It's not a loophole, it's illegal, very plain and very simple. Entering on a visitor's visa with the intent to remain in the US is visa fraud. Don't do it - and don't advise it.

No, No, No. Marrying is ok. Staying and attempting to adjust status afterward is visa fraud in a case where that was the intention upon entry. Having filed a fiance visa petition is clear evidence of immigrant intent. Had you actually married on the spur of the moment on a visit before the petition was filed, you would probably have been ok.

Facts are cheap...knowing how to use them is precious...
