K1 extension possibility?

Hello Wonder-Full VJers,

I am so curious.

I did a search and did not find this info.

For personal reasons, I do not think that 3 months is enough time.

(This has nothing to do with needing more time to plan a wedding.)

Does anyone know if it is possible to ask for an extension once you enter the U.S.?

(I mean get an extension to get married. I know we have 6 months to use the K1 to enter.)

Landed permanent resident approved – August 23rd, 2010

Second funny looking card arrives – August 31st, 2010

The 90 day requirement isn't going to change any time soon. Use the six months for the visa execution to do your planning.

Thank you Kez, even though you did not give the answer I would have liked to have heard. :)

You do have six months to use the visa once you receive it at the consulate, and then 90 days to get married once you've crossed the border. C. got his on Valentine's Day, and didn't enter the U.S. till Memorial Day. That gives you almost nine months to play around with.

EAD card ordered again (who knows, maybe we got the two-fer deal): 10/23/-7

Timeline

Some canucks have had luck crossing into the USA after the K1 interview and NOT activating the K1 visa, just coming in as a tourist!, then heading back to canada, then crossing and activating the visa!! No gaurentees that would work!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

You can certainly do that too :thumbs: Several have posted success in doing that

If you don't get married within the 90 days, all is not lost. After the 90 days, overstay days start accruing. If you do eventually marry after the 90 days, you can't adjust status based on the K-1, but you can file the I-130 spouse petition concurrently with the I-485 for adjustment of status. If you don't eventually get married, the overstay days may cause trouble for future return to the US--depending on how long you remain in the US.

Now this is interesting. Hmmmm....

Being I'm not versed yet on what exactly happens after marriage and the onslaught of paperwork, how does this differ from paperwork of applying for AOS if married within 90 days of entering the U.S.?

Although I can be quite spontaneous at times, I do not want to be rushed into "the wedding".

This is not to say I have a single doubt about my love for my Chicago-ite (?) sweetheart, nor his love for me.

It is as great as the universe, nay, the multiverse! :star:

If you don't marry within the 90 days, as already mentioned you'll have to file the I-130 along with your AOS paperwork. I-130 = more money & proof of bonafide marriage.

Also in the time that your I-94 expires and before you file for AOS, you will be out of status (which may or may not be important to you). You won't be able to file for advance parole if you need to travel, you won't be able to file to work and depending on if and where you travel within the U.S. (e.g. southern border states) you may run into problems at immigration checkpoints along highways. Actually that goes for anyone out of status.

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!
