Please advice!

In Sept. 2006, I went back with my friends to visit the North sides of Viet Nam. I meet Q in HP. We get along right away, but he is a divorced man with a baby boy. I left Vn without any promises. One thing that kept me thinking and don’t know whether or not I should be with him is his situation. Over the year, we keep in touch up into March 2007. Then I called it off because I can’t accept him. We don’t talk or chat over few months, then in July I went back to Vn with my family, I missed him and his son so much so I call him again. We didn’t meet at all during my trip bc I stayed in HCM for only three weeks. I went back to US and we keep in touch ever since, I finally make my decision to be with him. I want to begin to file my I-129F.

Here are my concerns:

1. We don’t keep any record of chat, email, mails or phone bill from Sept. 2006 to August 2007. Because we had a short break-up.

2. His parents don’t have any birth certificates; do we need them for the interview?

3. Should I tell the whole truth about us up from the day we first meet and until now in the file? Such us we had a short break-up, we didn’t keep any record of on going relationship up until August 2007.

4. Should I send in a copy of my boarding pass of my second trip?

5. I’m planning to go back to visit him and his family in spring. Should we have an engagement party?

6. I don’t have a saving account, only checking. If that is okay?

7. I do make over 30k a year. In January 2008, I’ll be working for one year. I will have my tax, w-2, etc. for the interview. I just graduated from college in August 2006. Will it be a problem?

I would be very careful when filing for I-129F because of the following:

1. You haven't known each other that long.

2. You have met in person only once.

3. You don't have any evidence.

4. He has a son. This should not be an obstacle, but it complicates things a bit having to deal with the divorce paperwork the ex-wife's information.

5. (My speculation) USCG in HCMC sees more male US citizen applications than female ones. You case would definitely stand out. This should not discourage you. The truth will win. But be conscious about it and prepare well.

Re your questions:

Parents birth certificates: usually not needed. But at the interview if they suspect kinship, they may check your parents' and his parents' birth certificates. Does he have any other paperwork that show his parents' names, birthplaces, grandparents' names, etc. I would be good to bring that to the interview, just in case.

Telling your story: you should never lie. How much you include in your statement (how you met) is up to you, but include enough that tells your story. Again, if asked, never lie. It's difficult to prove a lie, and may lead to serious consequences.

2nd trip boarding pass: I don't know how this would support your case. You two never met during this trip anyway.

Engagement party: you should have one, especially in your case because you lack several things. However, that is not a substitute for MORE communication, MORE visits, LONGER time to know each other.

Your income: should be okay for a family of 3 (let's count his son). Saving account: not required. As long as you have a decent steady balance for at least 6 months before the interview, and you have other things (employer's letter, e.g.). Get a statement from your bank to prove that.

You need to strengthen your case, and your relationship, and that will only come with time. Ask yourself: is NOW a good time to file for I-129F? What do I have? What do I lack? Make the judgement yourself.
