Exact steps to K-3 visa to Green Card

Timeline

Hey everyone, don't throw rocks at me for asking this question. I tried to look the thread with this info, but had no luck.

I wonder what exact steps must happen between filing for I-129F and I-130 and the receipt of the green card. I need some education and relief from predicting what happens when.

1. Ok. We get married, then we file for I-129F and or I-130 and get NOA 1

2. case might be touched once or few times, REF may happen

3. but eventually case gets approved, i.e. NOA2

---- we chose which route to take --- is that true? and if yes,

4. what happens after NOA2 on I-129F?

5. what happens after NOA2 on I-130?

6. how long does it takes between NOA 2 and interview notice?

7. medical exam happens. is the fee still 200 dollars???, police report

8. interview at the consulate

9. K-3 visa issued (on the spot?)

10. spouse arrives (YIPPEEEE)

11. now what?

12. we file for EAD, SS - are we subjects to new fees, or we will be honored the old fees

13. When do we file for AOS?

I do believe that if your wife enters as a K-3, she applies for Adjust of Status upon the approval of the I-130

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Actualy I have seen many apply before I-130 approval, get interviewed, but end up "Approved" Pending I-130 Approval.

Apply also for EAD with AOS and there is no additional fee.

Apply for EAD before applying for AOS and you pay $340

Start with the AOS Guide. Yes, you'll pay the new AOS fee of $1010. It includes EAD if you want to apply for that too.

The steps are as follows:

1. Send in I-130 and any additional docs they require

2. When you receive NOA1 - receipt letter, send in I-129F forms

3. Wait for approval... for us, it took a couple months

4. Approved I-130 on hold (kinda), I-129F approval/docs sent to embassy abroad.

5. When notice that case is being transferred to embassy, contact embassy or go to their website and get all the forms ready, send them approx. 2-3 weeks after transfer notice (this gives time for embassy to receive)

6. A couple weeks later, you should receive K-3 interview letter

7. Get medical exam done a month or few weeks before interview

8. Go to interview, bring copies of everything from I-130 and I-129F and any additional docs they request in interview letter (proof of relationship)

9. If approved, should receive visa and a sealed packet (do not open) in mail a few days later

10. Come to USA, at POE (point of entry) give sealed packet to passport control officer and have I-194 stamped, stapled into passport

11. Send in AOS/EAD forms - with copy of approved I-130 letter

12. Start preparing proof of relationship and common residence in USA (ID card or drivers license, add to medical benefits, bank account together, add to car insurance, photos with family/friends)

13. Receive biometrics appointment letter, approx 1 month after receipt of AOS/EAD forms

14. biometrics appointment

15. have another medical exam (use supplemental form)

16. within 90 days of filing EAD, receive employment authorization card

17. depending on location (check USCIS website for processing times), anywhere from 3-6 months for AOS interview maybe longer... it varies.

Item 15 has me worried. Do you have evidence of a bonified marriage? As newlyweds there is a lower threshold but it's not clear what's rquired.

2-2-07 Sent I-129F to NSC

2-6-07 NSC received USPS mail, NSC then to CSC

2-15-07 NOA1 -file received

2-16-07 check cashed

2-23-07 touched

5-4-07 NOA2 approval -email

5-13-07 sent cancellation request letter

6-7-07 we're going to retry with a K-3

8-6-07 married in Thailand (dual language, dual representation prenuptial)

8-7-07 sent K3 from Bangkok

9-10-07 I-130 NOA1, (received at CSC 8-9-07)

10-9-07 sent I-129F to CSC

11-1-07 touched I-130

requested consular processing I-130 (http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf)

9-13-07 I-129F for Spouse arrived CSC via USPS return rcpt. requested

4-1-08 NOA2 for K3 (I-134 supposed to be processed but processed I-129F instead)

7-11-08 interview Bangkok, passed.

7-16-08 POE arrival, 2 hours in Seattle Customs.

AOS I-486 sent 4-4-09

AOS NOA1 4-13-09 for all; I-485, I-131, I765

RFE 4-27-09 Thai official document in lieu of original Birth Certificate not sufficient???

Infopass appointment 5-26-09 at USCIS. Officer thought our doc was valid and doesn't know why the RFE.

7-28-09 EAD and AP sent

Social Security card 8-4-09

interview 9-10-09

10 year green card expires 9-17-19, Permanent Resident Card.

Resident since 9-10-09.

yes, i did not know that there is another med exam in usa? i did not have to do it when i immigrated. but that was 10 years ago

do you know how long it takes between notice of transfer to the actual interview?

Once they send you notice that the case is being transferred to the embassy abroad... wait 2 weeks and email or call the embassy to confirm if your case has arrived. If it has, ask if you can send in all the K-3 forms... since every embassy is different (Ankara said we didn't have to wait for the packet of forms from them, to download the forms from their website and send in)... once they receive the forms, it can take a few weeks to a few months to have interview date scheduled (depending on embassy)... but ask them how long it'll take. As long as you have all your forms and required documents in order, it should go smooth.
