"You can't prosecute somebody for swearing at a cop or a toilet," she said.

In New York City the is a subsection of disorderly conduct called "Disorderly Conduct - Obscene Language/Gesture" so technically you can be prosecuted for this. I've written this summons several times, but there is always a lot of discretion involved. I would definitely not write the summons in this situation and the paper reporting $300 and/or 90 days in jail must be a gross overstatement. I don't know what the exact fine is here and I'm sure it varies, but I would guess maybe $100 and zero jail time.

That said, I agree for the most part, the lady should be allowed to curse at her toilet all she wants. However, the neighbor did give her the courtesy of (presumably politely) asking her to stop and keep it down and she ignored this request.

maybe her choice of words caused the cop to think she was talking to him.......

hmmm what kind of words was she saying thinking that it was towards him... was she calling the turds in the toilet a big fat pig or that is a porker of a #######..
