How long after cancelling AOS can I file for a new TN Visa?

My marriage is not working and we both agreed to divorce amicably.

I need to send letter to withdraw AOS but I wonder if I can stay in the country and if I have to wait a certain period of time before filing for a new TN visa.

The company lawer thinks I should stay in the country and file but in IMHO I would be out of status if I stay here?

He's also worry it won't work because I filed before for AOS but if they receive the withdrawing letter and update their system I don't see why I would have problems?

I have been in the US for 6 years now with TN before getting married.

P.S. TN1 visa are renewable every year for sponsored Canadian in the US.
