I am not sure which is the right way.

People wait years for the namecheck to be completed (as we are) and somehow this is circumnavigating the system? Isnt it more prudent for these checks to be completed in a timely manner? It should be more infuriating how long these checks take while the person is sitting inside the country.

ETA: more often than not now, these lawsuits are dismissed due to regulations in USCIS passed in Dec 2006 essentially "closing" the loophole. Only a few sympathetic judges in some areas will hear the case.

Actually that may not be the case any more. This is only one example of several similar cases I've come across in the past few months that have mandated USCIS to expedite the "name change" delay. But this is the first time I've seen the judge actually implement the oath of citizenship.

Actually that may not be the case any more. This is only one example of several similar cases I've come across in the past few months that have mandated USCIS to expedite the "name change" delay. But this is the first time I've seen the judge actually implement the oath of citizenship.

I guess I am not following you. Most cases get dismissed now than last year. Many many many Writ of Mandamus cases have been filed in the past few years, most with the immigrant being granted their PR or citizenship as a result. Only since Dec 2006 have we seen as a change in the ability to sue. Even with the change, there are a few who are still approved and expedited as a result. Note this case is in Massachusetts.

That is what I was referring to when I said only a few sympathetic judges will hear the cases now. It used to be the majority, but some now still do get approved.
