Hi all.. I guess the headline says it all really. I was wondering.. When my wife gets here she will be part owner and mabey full owner in my company. Is this going to be a problem? If I understand right, she can't get a ssn for 2 years. Any suggestions?? Thanks

Apply for EAD as soon as your wife arrives, then use the EAD to get the SSN. K-3 can get EAD that is valid for the length of the I-94 card, up to two years.

Being partial owner in your business should not cause a problem.

Well, it doesn't take two years to get an SSN and she CAN file for EAD but with the new few structure, they'll want to file EAD with AOS. Realistically, she can have an SSN about 4 months after filing.

Ownership isn't a problem unless she needs an SSN to complete any ownership paperwork. Writing her a check for salary is a problem. Actually working in the business is "working".

On the other hand, I didn't think twice about having my wife and daughter staple some marketing materials together for my business, so I guess technically, they "worked" an hour or so without EAD. :no:

If you want to wait to file EAD with AOS because it's expensive to do it separately, you can request a Federal Tax Identification Number. That will allow her to complete the tax requirement for business registration until she gets a social security number.

Requested EAD Expedite: 11-12-2008

EAD Card production ordered: 11-12-2008 changed to 11/17/2008 Why? (I hope it doesn't change every week!)

Received AP: 11/17/2008

Received EAD: 11/22/08 (Praise God!!)

AOS RFE: 1/29/2009

AOS Approved: 3/24/2009

Called USCIS 4/1/2009 told no status change and case not yet reviewed from RFE request.

Received green card: 4/3/2009
