Hi.

I know there is tons of info here about how to get drivers license in the US when waiting for AOS appr., but I just couldn't find an answer to my case...

I came here on a K-1 visa from germany (I'm in PA now) and got married in July, I got a SSN and now also an EAD. I wanted to get a drivers license about 6 weeks ago and went to the DMV with all my papers and my german license. The lady there told me, that I don't have to take a new test, she just took some copies of my german license and my papers, said that she needs to fax that to germany to comfirm that my license is real and than I get issued a PA one. I didn't have my EAD than so that was the only way to get a license (that's what I thought at least :whistle: )

Now that I got an EAD can I just go to a different DMV and get a license there? I'm even willing to take the test and everything, I just really need the license.

Did someone else have the same problems? Any advise is wellcome!!!!!!!

Why can't you just go back to the one that you had been at before? I'd go to the same one that took your license and was contacting Germany. Show them your EAD. I don't know what the computer system is like in PA, but if you went to a new office, they might want to re-do that whole procedure again, such as faxing the old license to Germany.

I think I've also read on here that German license's can be transferred to a US one as well.

I've asked that one lady at the DMV if I can just take the test and get the license that way and she said NO, because I already have a license and I can't have 2. If I'd go to a different place I don't have to tell them that I have a german license and just start up new. She didn't put any of my informations in the computer so they don't know that I got a license. Plus I don't want to give up my german one cause it's good for a life time and it would take for ever to get a new one... Oh, and it cost me a sh... lot of money :D

I know that they can be transferred, and that's what she was trying to do at the DMV, but it's kinda weired that it's been over 6 weeks and I still don't have it...

Ahhh, okay, I understand better. Did this first lady say that as soon as she heard back from Germany that she'd just send you your license? Maybe you have to call her or go down there. Six weeks is a long time to hear back from Germany, but maybe she has heard back and she's just waiting for you to come back? I'd say go down to the same place again, to see what's going on. If they've heard back from them, they might be able to just give you your license when you go there. If you still have your German license, just drive on it until you get your new one.

HI,

for a drivers license, go to the DMV, they will give you a choice of forms to bring in. These will show that you have a permanent residence of that state. A bill with the AOS applicants name and address on it, and bank statements, phone bills etc.

That should take care of the paper work.

The I-94 and a passport will also be needed to show the entry visa.

wow, we have already recieved our Biometrics appointments. It is only 2 1/2 weeks away.

It seems to be moving rather quickly.

Did you apply before or after you submitted your AOS paperwork? What kind of paperwork did you submit to the DMV?

From Penndot (requirements for non-US citizens here) there are two ways you can get a DL if you came in from a K1:

1) Before AOS filing, under K1 category:

  • Passport
  • I-94
  • Visa
  • Social Security Card, or letter from SSA indicating that SSA did not make a decision yet, or SSA rejection letter
  • Marriage Certificate showing proof of marriage to U.S. Citizen
  • Proof of Citizenship of spouse
  • 2 proofs of residency

2) After AOS filing, under "Applicants for adjustment of status":

  • Social Security Card, or letter from SSA indicating that SSA did not make a decision yet, or SSA rejection letter
  • 2 proofs of residency,
  • Immigration documentation indicating status
  • One of the following:
    • Employment Authorization Document I-688B or I-766
    • Passport

I don't think that having an EAD will make a difference either way since it's optional in #2. Most likely the delay is in what the lady said about checking that your license was from Germany. Regardless, you've already applied for a PA driver's license. I'm not sure whether you'll need to surrender your license when you receive your PA license. When I spoke to the driver service centre in Vancouver about my Canadian driver's license, they told me I would need to surrender it once I applied for a PA DL.

Best thing to do is go back to the office you were at, talk to them again, and see why it's taking so long. Six weeks is a long time :blink:

Hi...

I'm in contact with that lady at the DMV at least once a week (... I call her and ask her about my license... she probably hates me already :lol: ) I know for sure that I can keep my german license when I get a PA one.

About the EAD... I think I've read somewhere that when you apply for a license you can get one when you get your EAD... oh well, maybe I was dreaming, I don't know. :blink:

BTW I applied for it AFTER I filed for AOS.

Oh, and I do still have my german one, but (the same lady) at the DMV told me that the german license is only good for one year after entering the US. Oh, and it's funny, but she actually told me that that's the first german license they are transfarring here so they don't really know how. :huh:

It just really sucks that I have to call her once a week just to find out that I can't get a license yet, plus I don't want to get in trouble when I get pulled over by a cop or so.

I don't know if it's like that in all states, but yeah, if you got a german license you don't have to take the US one... at least in PA and as far as I know WA.
