My wife (US) & I (Australia) are just about to start the process for the K3 spouse visa, but have a couple of questions....

1. I previously worked in the states on a work visa & was given a Social Security card with number but endorsed only with DHS approval. Should I use this number in my application?

2. Is it advisable to use an immigration lawyer?

We want to get this started in the next couple of days, so please reply soon.

Yes, put your SSN on any and all forms that ask for it. Its yours for life.

Usually most folks can do the paperwork on their own and don't need a lawyer. If you have no criminal record, and no other circumstances that would require legal attention, the paperwork is fairly straightforward. Save your money for something else. Like a root canal. Way more fun than a lawyer!

Yes, put your SSN on any and all forms that ask for it. Its yours for life.

Usually most folks can do the paperwork on their own and don't need a lawyer. If you have no criminal record, and no other circumstances that would require legal attention, the paperwork is fairly straightforward. Save your money for something else. Like a root canal. Way more fun than a lawyer!

Lawyers are really a waste of time unless you need one. They file the same paperwork using the same process as everyone else who files without using a lawyer does. Additionally, cases with lawyers don't get any special or preferential treatment by USCIS. So basically, unless you have a special legal need (i.e. overstayed visa, criminal record, deportation) then the paperwork and instructions are all pretty self explanatory

I-130/CR1 visa

04/23/2007--NOA1 Date from CSC

10/15/2007--NOA2 Date, FINALLY!!

I-129F/K-3 visa

05/23/2007--NOA1 date, currently at NBC (MSC)

10/15/2007--APPROVED!!! (NOA2 Date)

11/09/2007--I-129F petition forwarded to U.S. Embassy in Lima, Peru

12/12/2007--interview in Lima, Peru...VISA APPROVED!!!

12/26/2007--POE was Miami, FL and final destination was Charlotte, NC

I-485/AOS and I-765/EAD

3/18/2008--NOA1 Date from MSC

4/08/2008--biometrics appointment

5/07/2008--I-765/EAD approved

5/14/2008--EAD received in the mail (albeit wrong birth year)

9/30/2008--AOS Interview...AOS APPROVED and I-551 stamped in Passport!!!

My next question;

Can I send all paper work to one service center or do I need to seperate it & send the I-130 to NE & the I-295F to CA as described in the USCIS website?

I see that some of you huys have sent applications to Chicago. My wife lives in IL, so can we send the files there?

Have you really thought through whether you want to file an I-129F and go down the K3 path instead of CR1?

If so, send both petitions together to the appropriate service center. Depending on where you live, it will be California or Vermont.

Study this to understand why. Instructions have changed. If you I-129F instructions mention sending to Chicago, you don't have the up to date form or instructions.

From my research thus far, I see that the K-3 allows me to enter the US while I wait for the processing of the I-130. I also read that by aplying for the K3, you are also applying for the CR-1 by default.

Thanks for the links that you supplied. Now it's a little clearer. :)

Yes, but that only works IF the I-129F is approved before the I-130! Sometimes lately it isn't.

I think now with all the changes, monitarily speaking, the CR1 really is the best route, and it only takes about a month longer than the K3 in most cases.

What you read in the links above, supercedes the information you say you understand. At present, by filing the I-129F, you are saying you want a K3 visa and will adjust status in the US. You can't get a CR1 visa if your I-130 never gets to NVC and beyond. If you want a CR1 visa, don't file the I-129F at all.
