Hi All,

Great site and lot's of good info.

I just submitted my I-130 for my new wife. We are planning for the CR1 Visa and as I understand after the I-130 is approved it will be forwarded to the Visa center and they will contact about the next steps.

We 're also working on a job here using a L1 she currently has with our company. If she gets hired she may be working here on the L1 mid February. I expect he CR1 won't be complete by then. Her L1 will expire in 2009 so we want to make sure the green is here before then.

When she arrives in Mid february should we do the AOS in I-485 or continue with the CR1 or maybe we can't continue with CR1 since interview needs to be in home country.

One other thing she has is a B1/B2. If we wanted to get her here workign faster. Could we do the b1 to get her here and then go for the I-485. I've read that by law the EAD must be completed in 90 days. Does that mean she will be working by 90 days after the I-485 is submitted. Does the I-130 need to be approved before starting the I-485 process.

I've also read the I-485 travel restriction doesn't pertain to the L1 Visa holder, is it true?

I know lot's of questions.

I cant answer many of these questions but I can give you some info on the L1. I have an H1 and I worked on the paperwork for a colleague who now has an L1. You are right, travel restrictions dont apply to H1 and L1 provided you are in status (i.e. you are employed, and dont switched to an EAD or AP etc. ) Also you can come in on the L1 or H1 even though you have shown immigrant intent becasue these are dual intent visas. This may not be possible on the B1.

Now be aware that while this is the case, some CBP officers at airports and borders are not overly familiar with the rules. So everytime I travel to Canada with my US citizen wife and come back I get hassled a little bit "we cant let you in without an advanced parole. you cantjust use your H1B" then I show them the official rules from the i-485, get referred to a supervisor and then it works out. You may face this too. Hope this helps

Aug 31, 2007: Biometrics Appointment

Sep 1, 2007: Received NOA1 (Dated Aug 29)

Nov 25, 2007: Received notice for interview in Baltimore, MD (No touches, nothing online to date)

Jan 22, 2008: Interview in Baltimore, MD. Went well.

Jan 29, 2008: Can finally track I-130 online. Approved.

Jan 31, 2008: Email I-485 "Card production ordered"

Feb 5, 2008: Another email I-485 "Card production ordered"

Feb 7, 2008: Received I-130 approval and I-485 "Welcome to America Letter" in snail mail

Feb 7, 2008: Email I-485 "Approval notice mailed"

Feb 9, 2008: GC in hand....... (Done with USCIS for a few months) YAYY!!!!!!

Oct 22, 2009: Process starts again. Going to mail I-751 to VSC

Jan 26, 2010: Notice of Approval and Card Production for 10-year GC

Feb 3, 2010: 10-Year GC Received

I forgot I posted this. Can you help me find these rules your mentioning. Your saying if she arrives using a L1 and then we process the I-485 then she is not subject by parole restrictions since she has the L1?
