Personally, I never thought of drafting a will until 9/11. Now many employers in NYC routinely offer free legal services to help workers draft their wills. It never came to mind that I needed one until then, not having much - unfortunately - to leave behind. My kids and husband are on my will now. I also deposited money in a separate savings account for each of my children (CDs).

Sometimes I think I know everything, and I regain consciousness. Seen it all, done it all, forgot most of it....

So I talked to my husband about this last night. I asked him why he hasn't changed his Will since he and his ex-wife had been divorced for three years. He said since he was single, no siblings and his mother is old, and they have a child he didn't thought much about it. I asked him, then why didn't you tell me about it, we've been married for 7 months? He said he wanted to wait ' till I get here int he US so we can do it together so that we can talk about it and that I will have a say in his Will. I told him I've been here for a month now and you have not said anything about it 'till I saw it and asked about it. I think this matter is very important and should have been dealt before I got here or as soon as I got here.

I don't really know what to think and I'm confused about his reasons. It hurt me. If something had happened to him, I can't do anything?He said he will change it and had talked to a lawyer already. But this matter had hurt my feelings.

Don't let this hurt you. I know that is easier said than done, but really it isnt worth the stress. If he was refusing to change anything then it would be, but he says he will and not only that he wants to include you in the decisions. That is a good thing. I have been married nearly a year and have not changed mine yet. I have been putting thought into it, but no actual changes yet. (Fortunately my mother is my executor right now so I see no need to actually rush this)

I think it would be much better to skip the "why haven't you ?" part and go straight to "why don't we take care of it now ?". That is, unless what you REALLY want is to make him "pay" for hurting your feelings...

So what happens to your property and assets if something (God forbid) happens to you? You both need one. But of course, that is entirely up to you.

So what happens to your property and assets if something (God forbid) happens to you? You both need one. But of course, that is entirely up to you.

Yeah.. what would happen if you were to get in a car wreck tomorrow ... who would make the decisions regarding what you wanted.. what if you were comatose... who could make the decisions for you and what decisions could be made...

Remember Terri Schiavo... her parents and her husband spent over 10 years while she was completely comatose fighting over what could be done with her...

Taking care of your life issues are just as important as taking care of his... you both need wills and powers of attorney for financial and medical affairs.

I agree with you.Me and my husband first took care of his will because he had existing will and I was not in that will. His ex-wife was named as his personal representative so he changed it. I guess right now, I don't have one, it will be my husband. We will get a living will soon.

Whether a beneficiary named on the will can be a witness depends on the state.. some allow it.. others don't. In Michigan, it doesn't need to be witnessed at all.. but almost always is to prevent challenges to the will.

Who should witness the will? Anyone in particular? Could it be the lawyer's secretary or something, or does it have to be someone who knows you?

Abby (U.S.) and Ewen (Scotland): We laughed. We cried. Our witness didn't speak English. Happily married (finally), 27 December 2006.

holographic wills are valid also as long as done correctly. not suggested but valid if you dont want to spend a few bucks. just has to be done in your own handwritting on blank paper......free!!!

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

It can be any two people of legal age.. they don't have to know you..

I looked on the MN Statutes and it says there...

524.2-505 Who may witness.

(a) An individual generally competent to be a witness may

act as a witness to a will.

(B) The signing of a will by an interested witness does not

invalidate the will or any provision of it.
