Hi, :help:

I'm a US citizen. I got married in April 2007 in Pakistan. After consulting with friends, I filled i130 when I received the receipt notice then I sent i129f along with receipt notice on i130. Yesterday I received email from USCIS updating me that approval letter for i129f and i130 are sent.

Now I need you guys to advise me whether I should drop i129f and proceed with i130 or drop i130 and proceed with i129f?

Couple of my friends who only filled i130 are waiting for the interview date. One guy got interview date after 6 months and the other got date after 7 months Ghee that's long time.

If I go the i130 route then obviously it's going to take may be 10 months before my wife gets visa however if I understood correctly i129f is much quicker then that but don't know the timeline between the approval and visa?

Also if someone can please explain what's the process like once my wife enters US on i129f.

I read that press release...several times. It's in writing as to what their procedure is, but they DO NOT always follow procedure.

As in my case, I originally filed for a K-3 Visa (4/3/2007). My I-130 was NOT held back at the service center, like the press release says. It was forwarded to the NVC. Since that time my I-130(CR-1) has gone thru all the steps and is presently waiting for the final document to be approved(DS-230). It will be approved in the next day or so and will be forwarded to the Embassy. I did not stop or abandon my I-129F. Since then my I-129F was approved and has already reached the Embassy. I already have a K-3 intervew date set up in 3 weeks. What I am expecting to happen is in the next day or so, my I-130/CR-1 will be approved and sent to the Embassy. According to the Department of State, once m I-130 reaches the Embassy, my interview will AUTOMATICALLY change to a CR-1 interview. My timeline is 6 1/2 months on the

I-129F/K-3 from submittal to interview and 7.25 months for the I-130/CR-1...really not that much difference. If you use James's Shortcuts you can save a lot of time. I highly recommend it!!!!

I think everyones journey is different and there are a lot of variables that come into play. I have learned that the USCIS does hardly anything per procedure. There are people here who filed before me and still haven't gotten approval. Some get both petitions approved at the same time, then others are approved in order as they were designed to be...You just don't know what will happen.

It really does depend on your individual situation, but I think the press release mainly applies if your I-129F petition is approved before or at the same time of the I-130, then your I-130 will be held at the NRC pending AOS with the K-3. If you get your I-130 petition approved before the I-129F, then your I-130 will continue as normal through NVC, while the I-129F could still be worked on at USCIS until approval. If both petitions make it to the embassy at or near the same time (before the interview date for either visa) then it will default to the CR-1 because that is obviously, the preferred visa.

Correct. Timelines really help. Michael_NC's timeline doesn't indicate they ever filed an I-129F. Even if they did, if the separation in filing dates is significant, the I-130 can easily be approved before the service center marries the two petitions together.

Also, since this is a relatively new procedure, we're seeing it implemented more consistently now than in the first few months of its existence.

Sorry, I'm new to the community here and don't know some the terms like NRC, AOS, CR-1 etc...can someone please tell me what are these acronyms?

Sure...NRC=National Records Center, AOS=Adjustment of Status, and CR-1=conditional resident visa received after completing AOS or an I-130 petition. CR-1 is same visa as IR-1 (immigrant resident) except IR-1 applies only after you have been married two years or more. If you are married less than two years, you will get the CR-1 and must apply close to your two year anniversary for the removal of conditions to get the 10 year green card, at which point you would have the IR-1 visa.

CR-1 is a conditional resident visa alright by it is not issued after AOS. People already legally in the US don't need visas. Visas are used to enter the US. After successful AOS, the applicant is issued a Green Card indicating their legal permanent resident status, not a CR1 or any other visa.

At the top of the list of forums is a link to the "Immigration Dictionary". It is quite useful. So are the "Guides".

I'm confused. i-129f (k-3) is for fiance how can I use this for my wife? In i-130 I have sent them my marriage certificate as well but don't know how i-129f will work.

The I-129F is used for K1 fiance visas and K3 spouse visas. The instructions that come with the form address how you use it for a spouse. I suggest you start with the guides for an overview of the process, then carefully study all instructions for the forms. Then come back with any remaining questions.
