Hi,

I just received a RFE for my I 485 (AOS) in the mail yesterday. Strange because we definitely sent in all they had asked for - but we are going to send it in again.

Anyway, now I am wondering whether that impedes my EAD and Advance Parole processing as well or if each is processed independently?

I need to go home for my brothers wedding over Christmas, therefore I would really appreciate your help and input.

Thanks a lot!!

Timeline:

08/24: got married

08/27: sent off package for AOS, EAD and AP

09/17: NOA for AOS, EAP and AP

05/10: date on RFE for AOS (received it in the mail on Oct. 20th)

10/10:biometrics exam

22/10: sent out package to Montana with requested evidence

11/08: EAD and Advance Parole approved - card production ordered

11/15: AP arrived

11/18:EAD arrived

Your EAD & AP may be stalled slightly while pending the RFE information as your interim benefits are tied to your eligiblity of AOS'ing. Depends on what the RFE is for. They will resume normal processing once the items have been received.

Thanks for the reply - I really appreciate your help.

The RFE referred to my AOS case (I 485) and was regarding evidence of I 864 - the Affidavit of Support. They wrote me a rather general and quite incomprehensible sentence ( I had found exactly the same wording on other sections of this forum):

(40) the sponsor or joint sponsor on Form I 864 Affidavit of Support must submit the following:

W2s, 1099s and /or all schedules submitted to the IRS - a copy of his/her tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return.

How long do you estimate the delay if we send in all our evidence (again..) immediately? (Their letter was written on 5th of October - arrived here yesterday..)
