Hi All, I posted the same in IR1, so sorry in advance for the duplicate post. I got approved for both my I-129F and I-130 petition today! I received the email about the I-129F around 9:30pm tonight, and about 2 hours got the email for the I-130. Now the dilemma on which visa to go with. Lets say we decided to wait for a few extra months more and get the CR1 visa because its better, how would I go about cancelling the K-3? Also, what is a realistic time for each visa to finish at NVC and then the embassy for my wife to be able to actually enter the U.S.?

I-130/CR1 visa

04/23/2007--NOA1 Date from CSC

10/15/2007--NOA2 Date, FINALLY!!

I-129F/K-3 visa

05/23/2007--NOA1 date, currently at NBC (MSC)

10/15/2007--APPROVED!!! (NOA2 Date)

11/09/2007--I-129F petition forwarded to U.S. Embassy in Lima, Peru

12/12/2007--interview in Lima, Peru...VISA APPROVED!!!

12/26/2007--POE was Miami, FL and final destination was Charlotte, NC

4/08/2008--biometrics appointment

5/07/2008--I-765/EAD approved

Congrats on the approvals! For the K3, I would plan on about 4-5 weeks for it to get to NVC, about one week (or less)for it to go through NVC, then from the day it leaves NVC I would plan on about 6 more weeks until the date of the interview in Lima. You would probably be looking at an interview date of around Christmas time.

I don't really know what to tell you regarding CR1 because we decided from the start to go with K3 and therefore I haven't read anything or kept up on the CR1 process. You could probably get a decent idea of a timeline by checking out recent timelines on the "Immigration Timelines" tab.

Thank you Erika's Husband! I am 99.9% sure we are going to go with the K-3 too just because we want to be together as soon as possible, even if that means another year of dealing with USCIS with the AOS stuff. Plus, if I remember correctly, I believe if your I-130 and I-129F get approved at the same time, don't they hold off on forwarding the I-130 to NVC and go ahead with the I-129F? If i'm right, then it doesn't matter as CIS chose it for us, but if i'm mistaken, please correct me.

Congratulations!! on your approvals.

Unless you requested Consulate Processing on your I-130 the standard practice is for USCIS to retain the I-130 for AOS.
