second k1 process....

Timeline

I am so glad i found this site.

I had an approved k1 visa and i travelled to the US to join my fiance but after a month i decided not to go on with the marriage since we have lots of big differences. He was a nice person but there were big things that we didnt agree and i could see that the marriage is bound to fail so i changed my mind. He wanted me to stay and go on with it but i was firm with my decision. I am glad he respected my decision. After a month in the US i decided to just enjoy and finish my visa then i went back home. While i was enjoying my time in the US my cousin introduced me to her co-worker and we continued the communication thru emails and long distance. Now, he wants to file a k1 petition for me so we can marry in the US. So, this will be my second k1 petition.

my questions are:

Does he need to visit me here in the philippines even if we already spent 1 month in the US together?

Do i need to ask some clearance from my former fiance?

please i need advice.

any advice is welcome.

03-28-08= mailed AOS package

04-07-08= reciv NOA

04-21-08= biometrics appointment done

05-22-08=reciv EAD approval notice by email

05-25-08= reciv EAD card

06-09-08= reciv email from CRIS about AOS approved and card production ordered.

06-16-08= GC in hand....THANK YOU GOD !

You need to show proof of having met. Do you have that documented? I would recommend that he come visit you.

Once you returned to the Philippines the initial petitioner is no longer involved.

I agree. the requirement of having met in the last two years will have been met if you have documention as proof.

his visiting you in the Philippines will give you stonger evidence of a genuine relationship when it comes time for the visa interview. I'm sure you'd also like to spend more time with him and have him meet your family.

Per the guidelines, your have satisfied that criteria, but you must provide proof. Below is an excerpt from Packet 4 concerning your question:

h. EVIDENCE OF A MEETING PRIOR TO THE PETITION. You and your petitioner must have physically been together at some point within two years before the petition was filed. Proof of this meeting should be submitted unless the U.S. Citizenship and Immigration Services (USCIS) waives this requirement. A few photographs of the applicant and petitioner together during the specified time may serve as evidence of this requirement. fiance must visit you in the Philippines.

Please refer to the Packet 4 instructions for more details.

Do i need to ask some clearance from my former fiance?

No! When your relationship ended. That was your clearance. (((smile)))

OTHER: I would be mentally prepared for the logical questions of when, how, and why you met and developed your new relationship by the CO during your next visa interview considering the point in time that you met your current fiance. Just a thought...
