Raphael, that is a terrible story! I'm surprised there was nothing you could do. Glad to hear that you finally got your visa, though.

To the OP, the trick is to take as much evidence of ties with you as you can carry. Oh, and don't lie about your purpose of travel; it could come back at you later in life.

Rental contract and proof of a bank account would already be a good start. Be prepared to be questioned, and most importantly don't get too worked up about the whole thing; there more nerves you show the more likely it is that someone will be suspicious. It'll all be ok.

OMG! Raphael! You should have sued the that guy! That´s absurd! Anybody can get married in US, even if both parties are foreign!

Not if the CBP officer suspects that the alien will attempt to stay in the US...

Whether that was the case here is not the issue... (IMO that guy was a complete @ss) But his reasoning for denying her entry is not completely out of line, the truth is nobody has the right to enter the US for anything except a US Citizen...

While unfortunate for Lily, it should serve as a lesson to us all that having a spousal or fiancee relationship with a USC is seen by the CBP as a very strong tie to the US and the amount of evidence needed to overcome that perceived tie could be significant...

That is NOT correct.

Visitors may marry in the US, it happens every day.

Unfortunately, the border officer was a ####### who wouldn't play nice with her.

Well you don't have any visa pending..you are just a person entering the US for a visit....you will have no problems and no one will ask you for ties to prove. I really don't understand your concern with this.

yes it does happen that people do marry without the proper visa, but the law is that you must apply for a visa if are coming to this country with the intention of getting married.

All i am saying is that is the law. and if you get caught you must pay for it, and if you dont hope you have a happy life.

"If your fiancé(e) is not a citizen of the United States and you plan to get married in the United States, then you must file a petition with USCIS on behalf of your fiancé(e). "

Sry but your wrong !!

It is not the law that you have to have a K-1 to marry in the states. Its the law that you have to have a K-1 to marry in the states and LIVE there.

I wasn't planning on living there. BTW, I asked the immigration officer about this when i went for my initial K-1 interview and he said I was in the right and the guy was just being (His words)" A Complete tool! "
