Timeline

We have the marriage license signed today(it will expire in 10 days) and we will mail it to the City Hall tomorrow. Can I apply AOS for my wife now ? or we have to wait for the marriage cert from City Hall ?

Your posts concerning your legal marriage have been difficult to understand. When did the beneficiary arrive in the US on the K1 visa? When was the legal marriage completed? Are you saying that you just recently legalized the marriage? Did the I-94 expire before the marriage was legal?

Timeline

The marraige license is permission to marry. You still have to get married. Then you have to file AOS with the marraige certificate. Make sure you get married before the visa expires.

Make sure you get married before the visa expires.

They need to be married before the I-94 expires. The visa has already been used and it's expiration is no longer relevant.

Did you go before a Judge, justice of the peace, priest or town official and say "I do" when asked if you take eachother as husband and wife"? Did the person then say "I now pronounce you husband and wife"?

Getting the license does not mean you are married.... once you have the license you have to take it to a person who is allowed to preform marriages... they will then marry you... you then have to take the license back to the place where you got it and have the marriage registered... they will then give you a Marriage Certificate.....

2 months before the K-1 visa interview. I'm assuming that this was not a legally binding marriage and not relevant to the question.

Thai,

You need to make an appointment to be married by a judge at a local court. You two would bring ID's for each of you, some cash for the fee, and that UNEXPIRED marriage license. The judge will ask you "Do you take this woman...?", "Do you take this man...?". You both say "I do" and he/she will "pronounce you husband and wife." He/she will put/print/stamp his/her name on your marriage license, and a couple of your guests will sign on it as witnesses. Your permanent marriage certificate (not license) will arrive in the mail in 2-3 weeks.

That's how it is in Texas. I'm not sure how it varies state to state, but I don't imagine it being too different.

Yes, you can apply for AOS for your biotch now, whether or not it will be approved or rejected, who knows, who cares! I know you do! So think before post your question, better off reading the FAQ's.

You should wait for the marriage certificate from City Hall, or just not. who knows! You might get lucky and don't have to send in Marriage certificate as prove of being married to your biotch who got a K-1 Visa to come to the US.

It's the other way around: your question is dumb ---> unclear answer.

To be clear with you:

Get marriage license ---> wedded by a judge (reverand/priest/someone who is authorized to do so) --->

---> get marriage cert. ---> apply for AOS.

If this is not clear enuf, you're not allowed to get married because you're toooo dumb!

:time: please update your timeline. it shows you were married May 17th yet your K-1 interview date shows

July 20th.

to answer your question, I'd wait till you have your marriage certificate from the county so you can make a photocopy of it to submit with your I-485.

also, alittle courtesy to those who are trying to help you can go along way... ;)

I probably should have responded to Thai's questions with courteous regardless of how many times we as a community asking him do not referring to his fiance/wife as a B. I feel as if I speak the same language as Thais has been, it may get the message accross! May be it did, may be not!
